11 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 14 | | SECTION 1. Subtitle D, Title 3, Natural Resources Code, is |
---|
13 | 15 | | amended by adding Chapter 124 to read as follows: |
---|
14 | 16 | | CHAPTER 124. TREATMENT AND RECYCLING FOR BENEFICIAL USE OF CERTAIN |
---|
15 | 17 | | WASTEWATER AT OIL AND GAS DRILLING SITES |
---|
16 | 18 | | Sec. 124.001. DEFINITIONS. In this chapter: |
---|
17 | 19 | | (1) "Commission" means the Railroad Commission of |
---|
18 | 20 | | Texas. |
---|
19 | 21 | | (2) "Domestic wastewater" means wastewater that |
---|
20 | 22 | | originates primarily from kitchen, bathroom, and laundry sources, |
---|
21 | 23 | | including waste from food preparation, dishwashing, garbage |
---|
22 | 24 | | grinding, toilets, baths, showers, and sinks of a residential |
---|
23 | 25 | | dwelling. |
---|
24 | 26 | | (3) "Mobile drinking water treatment system |
---|
25 | 27 | | wastewater" means wastewater generated from the treatment of |
---|
26 | 28 | | surface or subsurface groundwater for drinking water purposes. |
---|
27 | 29 | | Sec. 124.002. BENEFICIAL RECYCLING OF CERTAIN WASTEWATER AT |
---|
28 | 30 | | OIL AND GAS DRILLING SITES. (a) This section applies to an oil and |
---|
29 | 31 | | gas drilling site regardless of whether the well has been |
---|
30 | 32 | | completed. |
---|
31 | 33 | | (b) The commission shall adopt a permit by rule for the |
---|
32 | 34 | | beneficial recycling of: |
---|
33 | 35 | | (1) treated domestic wastewater generated at oil and |
---|
34 | 36 | | gas drilling sites; and |
---|
35 | 37 | | (2) mobile drinking water treatment system |
---|
36 | 38 | | wastewater, including reverse osmosis reject water, generated from |
---|
37 | 39 | | oil and gas drilling sites. |
---|
38 | 40 | | (c) The commission, in adopting a permit by rule under this |
---|
39 | 41 | | section, must require: |
---|
40 | 42 | | (1) that discharges of treated wastewater at oil and |
---|
41 | 43 | | gas drilling sites are in compliance with the state's applicable |
---|
42 | 44 | | water quality standards for reuse down-hole or applied to land; |
---|
43 | 45 | | (2) notification of the start date and exact location |
---|
44 | 46 | | for each domestic wastewater or mobile drinking water treatment |
---|
45 | 47 | | system unit; |
---|
46 | 48 | | (3) reporting requirements that include: |
---|
47 | 49 | | (A) the total number of days domestic wastewater |
---|
48 | 50 | | or mobile drinking water treatment system wastewater is reused or |
---|
49 | 51 | | applied after treatment; |
---|
50 | 52 | | (B) the total volume of each type of wastewater |
---|
51 | 53 | | received for treatment; |
---|
52 | 54 | | (C) the total volume of treated effluent for each |
---|
53 | 55 | | type of reuse method, including down-hole, controlled irrigation, |
---|
54 | 56 | | and dust suppression; |
---|
55 | 57 | | (D) a table of the water treatment analytical |
---|
56 | 58 | | results, sampling dates, corresponding analytical reports, and |
---|
57 | 59 | | chain of custody for the parameters; and |
---|
58 | 60 | | (E) the filing of an organization report; and |
---|
59 | 61 | | (4) financial security assurances in an amount not to |
---|
60 | 62 | | exceed $200,000 per year for each active permit. |
---|
61 | 63 | | SECTION 2. Not later than December 1, 2021, the Railroad |
---|
62 | 64 | | Commission of Texas shall adopt the permit by rule as required by |
---|
63 | 65 | | Section 124.002, Natural Resources Code, as added by this Act. |
---|
64 | 66 | | SECTION 3. This Act takes effect September 1, 2021. |
---|
