79 relating to the adoption by the Railroad Commission of Texas of a
810 permit by rule for the beneficial reuse of domestic wastewater and
911 mobile drinking water treatment system wastewater produced at
1012 certain oil and gas drilling sites.
1113 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1214 SECTION 1. Subtitle D, Title 3, Natural Resources Code, is
1315 amended by adding Chapter 124 to read as follows:
1416 CHAPTER 124. TREATMENT AND RECYCLING FOR BENEFICIAL USE OF CERTAIN
1517 WASTEWATER AT OIL AND GAS DRILLING SITES
1618 Sec. 124.001. DEFINITIONS. In this chapter:
1719 (1) "Commission" means the Railroad Commission of
1820 Texas.
1921 (2) "Domestic wastewater" means wastewater that
2022 originates primarily from kitchen, bathroom, and laundry sources,
2123 including waste from food preparation, dishwashing, garbage
2224 grinding, toilets, baths, showers, and sinks of a residential
2325 dwelling.
2426 (3) "Mobile drinking water treatment system
2527 wastewater" means wastewater generated from the treatment of
2628 surface or subsurface groundwater for drinking water purposes.
2729 Sec. 124.002. BENEFICIAL RECYCLING OF CERTAIN WASTEWATER AT
2830 OIL AND GAS DRILLING SITES. (a) This section applies to an oil and
2931 gas drilling site regardless of whether the well has been
3032 completed.
3133 (b) The commission shall adopt a permit by rule for the
3234 beneficial recycling of:
3335 (1) treated domestic wastewater generated at oil and
3436 gas drilling sites; and
3537 (2) mobile drinking water treatment system
3638 wastewater, including reverse osmosis reject water, generated from
3739 oil and gas drilling sites.
3840 (c) The commission, in adopting a permit by rule under this
3941 section, must require:
4042 (1) that discharges of treated wastewater at oil and
4143 gas drilling sites are in compliance with the state's applicable
4244 water quality standards for reuse down-hole or applied to land;
4345 (2) notification of the start date and exact location
4446 for each domestic wastewater or mobile drinking water treatment
4547 system unit;
4648 (3) reporting requirements that include:
4749 (A) the total number of days domestic wastewater
4850 or mobile drinking water treatment system wastewater is reused or
4951 applied after treatment;
5052 (B) the total volume of each type of wastewater
5153 received for treatment;
5254 (C) the total volume of treated effluent for each
5355 type of reuse method, including down-hole, controlled irrigation,
5456 and dust suppression;
5557 (D) a table of the water treatment analytical
5658 results, sampling dates, corresponding analytical reports, and
5759 chain of custody for the parameters; and
5860 (E) the filing of an organization report; and
5961 (4) financial security assurances in an amount not to
6062 exceed $200,000 per year for each active permit.
6163 SECTION 2. Not later than December 1, 2021, the Railroad
6264 Commission of Texas shall adopt the permit by rule as required by
6365 Section 124.002, Natural Resources Code, as added by this Act.
6466 SECTION 3. This Act takes effect September 1, 2021.
