55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the enforcement of commercial motor vehicle safety
88 standards in certain municipalities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 644.101(b), Transportation Code, as
1111 reenacted and amended by Chapters 102 (S.B. 636), 163 (H.B. 695),
1212 169 (H.B. 917), and 467 (H.B. 4170), Acts of the 86th Legislature,
1313 Regular Session, 2019, is reenacted and amended to read as follows:
1414 (b) A police officer of any of the following municipalities
1515 is eligible to apply for certification under this section:
1616 (1) a municipality with a population of 50,000 or
1717 more;
1818 (2) a municipality with a population of 25,000 or more
1919 any part of which is located in a county with a population of
2020 500,000 or more;
2121 (3) a municipality with a population of less than
2222 25,000:
2323 (A) any part of which is located in a county with
2424 a population of 3.3 million; and
2525 (B) that contains or is adjacent to an
2626 international port;
2727 (4) a municipality with a population of at least
2828 34,000 that is located in a county that borders two or more states;
2929 (5) a municipality any part of which is located in a
3030 county bordering the United Mexican States;
3131 (6) a municipality with a population of less than
3232 5,000 that is located:
3333 (A) adjacent to a bay connected to the Gulf of
3434 Mexico; and
3535 (B) in a county adjacent to a county with a
3636 population greater than 3.3 million;
3737 (7) a municipality that is located:
3838 (A) within 25 miles of an international port; and
3939 (B) in a county that does not contain a highway
4040 that is part of the national system of interstate and defense
4141 highways and is adjacent to a county with a population greater than
4242 3.3 million;
4343 (8) a municipality with a population of less than
4444 8,500 that:
4545 (A) is the county seat; and
4646 (B) contains a highway that is part of the
4747 national system of interstate and defense highways;
4848 (9) a municipality located in a county with a
4949 population between 60,000 and 66,000 adjacent to a bay connected to
5050 the Gulf of Mexico;
5151 (10) a municipality with a population of more than
5252 40,000 and less than 50,000 that is located in a county with a
5353 population of more than 285,000 and less than 300,000 that borders
5454 the Gulf of Mexico;
5555 (11) a municipality with a population between 18,000
5656 and 18,500 that is located entirely in a county that:
5757 (A) has a population of less than 200,000;
5858 (B) is adjacent to two counties that each have a
5959 population of more than 1.2 million; and
6060 (C) contains two highways that are part of the
6161 national system of interstate and defense highways; [or]
6262 (12) a municipality with a population of more than
6363 3,000 and less than 10,000 that:
6464 (A) contains a highway that is part of the
6565 national system of interstate and defense highways; and
6666 (B) is located in a county with a population
6767 between 150,000 and 155,000; [or]
6868 (13) a municipality with a population of less than
6969 75,000 that is located in three counties, at least one of which has
7070 a population greater than 3.3 million;
7171 (14) [(13)] a municipality with a population between
7272 14,000 and 17,000 that:
7373 (A) contains three or more numbered United States
7474 highways; and
7575 (B) is located in a county that is adjacent to a
7676 county with a population of more than 200,000;
7777 (15) [(13)] a municipality with a population of less
7878 than 50,000 that is located in:
7979 (A) a county that generated $20 million or more
8080 in tax revenue collected under Chapters 201 and 202, Tax Code, from
8181 oil and gas production during the preceding state fiscal year; or
8282 (B) a county that is adjacent to two or more
8383 counties described by Paragraph (A); or
8484 (16) a municipality with a population of more than
8585 25,000 and less than 50,000 that:
8686 (A) is located in a county with a population of
8787 more than 150,000 and less than 200,000; and
8888 (B) contains a toll project of a regional tollway
8989 authority under Chapter 366 and a highway that is part of the
9090 national system of interstate and defense highways.
9191 SECTION 2. To the extent of any conflict, this Act prevails
9292 over another Act of the 87th Legislature, Regular Session, 2021,
9393 relating to nonsubstantive additions to and corrections in enacted
9494 codes.
9595 SECTION 3. This Act takes effect September 1, 2021.
