55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to waivers for entrance fees to state parks and certain
88 hunting and fishing license fees for resident first responders.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 13.015, Parks and Wildlife Code, is
1111 amended by amending Subsection (a-2) and adding Subsection (a-3) to
1212 read as follows:
1313 (a-2) The department shall waive the park entrance fee for
1414 an individual who is a first responder as defined by Section 42.012
1515 and who:
1616 (1) has completed at least 20 years of continuous
1717 service as a first responder; or
1818 (2) has a disability connected to service as a first
1919 responder that consists of the loss of the use of a lower extremity
2020 or of a disability rating of 50 percent or more.
2121 (a-3) The department may promote visits and enhance revenue
2222 at parks, including amounts necessary for salaries, advertising,
2323 consumable supplies and materials, promotional products, fees, and
2424 related expenses.
2525 SECTION 2. Section 42.012, Parks and Wildlife Code, is
2626 amended by amending Subsection (c) and adding Subsection (d) to
2727 read as follows:
2828 (c) In this section:
2929 (1) "First responder" means a person who is:
3030 (A) a firefighter certified by the Texas
3131 Commission on Fire Protection or by the State Firefighters' and
3232 Fire Marshals' Association of Texas;
3333 (B) an individual certified as emergency medical
3434 services personnel by the Department of State Health Services;
3535 (C) a municipal police officer;
3636 (D) a sheriff, deputy sheriff, or reserve deputy
3737 sheriff; or
3838 (E) a constable, deputy constable, or reserve
3939 deputy constable.
4040 (2) "Qualified disabled veteran" means a veteran with
4141 a service connected disability, as defined by the United States
4242 Department of Veterans Affairs, consisting of the loss of the use of
4343 a lower extremity or of a disability rating of 50 percent or more
4444 and who is receiving compensation from the United States for the
4545 disability.
4646 (d) The commission shall waive the fee or license
4747 requirement for a resident who is a first responder who:
4848 (1) has completed at least 20 years of continuous
4949 service as a first responder; or
5050 (2) has a disability connected to service as a first
5151 responder that consists of the loss of the use of a lower extremity
5252 or of a disability rating of 50 percent or more.
5353 SECTION 3. Section 46.004(c), Parks and Wildlife Code, is
5454 amended to read as follows:
5555 (c) The commission shall waive the fee for:
5656 (1) a qualified disabled veteran as defined by Section
5757 42.012;
5858 (2) [and for] a resident on active duty as a member of
5959 the United States military forces, the Texas Army National Guard,
6060 the Texas Air National Guard, or the Texas State Guard; and
6161 (3) a resident who is a first responder as defined by
6262 Section 42.012 and who:
6363 (A) has completed at least 20 years of continuous
6464 service as a first responder; or
6565 (B) has a disability connected to service as a
6666 first responder that consists of the loss of the use of a lower
6767 extremity or of a disability rating of 50 percent or more.
6868 SECTION 4. Section 50.002, Parks and Wildlife Code, is
6969 amended by adding Subsection (c) to read as follows:
7070 (c) The commission shall waive the fee for an annual
7171 combination resident hunting and fishing license for a resident
7272 who is a first responder as defined by Section 42.012 and who:
7373 (1) has completed at least 20 years of continuous
7474 service as a first responder; or
7575 (2) has a disability connected to service as a first
7676 responder that consists of the loss of the use of a lower extremity
7777 or of a disability rating of 50 percent or more.
7878 SECTION 5. This Act takes effect September 1, 2021.
