| 6 | 6 | | relating to the rights of a holder of a brewpub license. |

| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 74.01, Alcoholic Beverage Code, is |
|---|
| 9 | 9 | | amended by amending Subsection (a) to read as follows: |
|---|
| 10 | 10 | | (a) A holder of a brewpub license for a brewpub located in a |
|---|
| 11 | 11 | | wet area, as that term is described by Section 251.71, may: |
|---|
| 12 | 12 | | (1) brew, bottle, can, package, and label malt |
|---|
| 13 | 13 | | beverages; |
|---|
| 14 | 14 | | (2) sell or offer without charge, on the premises of |
|---|
| 15 | 15 | | the brewpub, to ultimate consumers for consumption on or off those |
|---|
| 16 | 16 | | premises, malt beverages produced by the holder, in or from a lawful |
|---|
| 17 | 17 | | container, to the extent the sales or offers are allowed under the |
|---|
| 18 | 18 | | holder's other permits or licenses; [and] |
|---|
| 19 | 19 | | (3) sell food on the premises of the holder's |
|---|
| 20 | 20 | | breweries; |
|---|
| 21 | 21 | | (4) conduct samplings of malt beverages, including |
|---|
| 22 | 22 | | tastings, at a retailer's premises; and |
|---|
| 23 | 23 | | (5) enter into a contract brewing arrangement whereby |
|---|
| 24 | 24 | | the holder of a brewpub permit contracts with another holder of a |
|---|
| 25 | 25 | | brewpub permit, a holder of a brewer's permit, or a holder of a |
|---|
| 26 | 26 | | manufacturer's license to provide brewing services. |
|---|
| 27 | 27 | | SECTION 2. This Act takes effect September 1, 2021. |
