55 AN ACT
66 relating to the rights of a holder of a brewpub license.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 74.01, Alcoholic Beverage Code, is
99 amended by amending Subsection (a) to read as follows:
1010 (a) A holder of a brewpub license for a brewpub located in a
1111 wet area, as that term is described by Section 251.71, may:
1212 (1) brew, bottle, can, package, and label malt
1313 beverages;
1414 (2) sell or offer without charge, on the premises of
1515 the brewpub, to ultimate consumers for consumption on or off those
1616 premises, malt beverages produced by the holder, in or from a lawful
1717 container, to the extent the sales or offers are allowed under the
1818 holder's other permits or licenses; [and]
1919 (3) sell food on the premises of the holder's
2020 breweries;
2121 (4) conduct samplings of malt beverages, including
2222 tastings, at a retailer's premises; and
2323 (5) enter into a contract brewing arrangement whereby
2424 the holder of a brewpub permit contracts with another holder of a
2525 brewpub permit, a holder of a brewer's permit, or a holder of a
2626 manufacturer's license to provide brewing services.
2727 SECTION 2. This Act takes effect September 1, 2021.
