8 | 8 | | radioactive waste. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subchapter C, Chapter 401, Health and Safety |
---|
11 | 11 | | Code, is amended by adding Section 401.072 to read as follows: |
---|
12 | 12 | | Sec. 401.072. TRANSPORTATION, STORAGE, AND DISPOSAL OF |
---|
13 | 13 | | GREATER THAN CLASS C WASTE AND HIGH-LEVEL RADIOACTIVE WASTE. (a) |
---|
14 | 14 | | In this section: |
---|
15 | 15 | | (1) "Consolidated interim storage facility" means a |
---|
16 | 16 | | facility operated for the storage of radioactive waste from one or |
---|
17 | 17 | | more sources before disposal, not including a facility located on |
---|
18 | 18 | | the site where the waste is generated. |
---|
19 | 19 | | (2) "Greater than Class C waste" has the meaning |
---|
20 | 20 | | assigned by 10 C.F.R. Section 72.3. Section 401.005 does not apply |
---|
21 | 21 | | to this definition. |
---|
22 | 22 | | (3) "High-level radioactive waste" has the meaning |
---|
23 | 23 | | assigned by 10 C.F.R. Section 72.3. Section 401.005 does not apply |
---|
24 | 24 | | to this definition. |
---|
25 | 25 | | (b) Subject to Subsections (d) and (e), the commission may |
---|
26 | 26 | | not authorize: |
---|
27 | 27 | | (1) the acceptance of greater than Class C waste or |
---|
28 | 28 | | high-level radioactive waste for disposal or for storage at a |
---|
29 | 29 | | consolidated interim storage facility; or |
---|
30 | 30 | | (2) the transportation in this state of greater than |
---|
31 | 31 | | Class C waste or high-level radioactive waste that did not |
---|
32 | 32 | | originate in this state. |
---|
33 | 33 | | (c) Subject to Subsections (d) and (e), a person may not: |
---|
34 | 34 | | (1) accept greater than Class C waste or high-level |
---|
35 | 35 | | radioactive waste for disposal or for storage at a consolidated |
---|
36 | 36 | | interim storage facility; or |
---|
37 | 37 | | (2) transport in this state greater than Class C waste |
---|
38 | 38 | | or high-level radioactive waste that did not originate in this |
---|
39 | 39 | | state. |
---|
40 | 40 | | (d) If federal law requires the acceptance of greater than |
---|
41 | 41 | | Class C waste or high-level radioactive waste for disposal or for |
---|
42 | 42 | | storage at a consolidated interim storage facility in this state, |
---|
43 | 43 | | the commission may deny a license or other authorization for |
---|
44 | 44 | | disposal or for storage of the waste at the facility if the facility |
---|
45 | 45 | | does not satisfy all commission requirements. |
---|
46 | 46 | | (e) If federal law requires the transportation in this state |
---|
47 | 47 | | of greater than Class C waste or high-level radioactive waste that |
---|
48 | 48 | | did not originate in this state, the commission may deny |
---|
49 | 49 | | authorization for the transportation of the waste in this state if |
---|
50 | 50 | | all commission requirements regarding the transportation are not |
---|
51 | 51 | | satisfied. |
---|
52 | 52 | | SECTION 2. This Act takes effect September 1, 2021. |
