11- and private institutions of higher education, and other entities.
7+ relating to the development of a model data-sharing agreement for
8+ sharing student information between public schools, public and
9+ private postsecondary educational institutions, and certain
10+ community organizations.
1211 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1312 SECTION 1. Subchapter A, Chapter 7, Education Code, is
1413 amended by adding Section 7.012 to read as follows:
15- Sec. 7.012. MODEL DATA-SHARING AGREEMENTS. The agency, the
16- Texas Higher Education Coordinating Board, and the Texas Workforce
17- Commission jointly shall develop and make available the following
18- model data-sharing agreements for sharing information subject to
19- the Family Educational Rights and Privacy Act of 1974 (20 U.S.C.
20- Section 1232g) for purposes of system evaluation and improved
21- support of students and workforce preparation participants:
22- (1) a model data-sharing agreement for public schools
23- and public and private institutions of higher education to share
24- that information with entities authorized to receive that
25- information for use in ongoing system evaluation and improvement
26- purposes or whose employees or contractors are school officials for
27- purposes of the Family Educational Rights and Privacy Act of 1974;
28- and
29- (2) a model data-sharing agreement for reciprocal
30- sharing of that information between:
31- (A) public schools;
32- (B) public or private institutions of higher
33- education;
34- (C) state and local workforce entities; and
35- (D) entities authorized to receive that
36- information for use in ongoing system evaluation and improvement
37- purposes or whose employees or contractors are school officials for
38- purposes of the Family Educational Rights and Privacy Act of 1974.
39- SECTION 2. This Act takes effect September 1, 2021.
14+ Sec. 7.012. MODEL DATA-SHARING AGREEMENTS. (a) The agency
15+ and the Texas Higher Education Coordinating Board jointly shall
16+ develop and make available a model data-sharing agreement that may
17+ be used for sharing student information between public schools,
18+ public and private postsecondary educational institutions, and
19+ community organizations that support students pursuing higher
20+ education. To receive student information under this section a
21+ community organization must be approved for receipt of the
22+ information by the agency or the Texas Higher Education
23+ Coordinating Board.
24+ (b) The model data-sharing agreement must:
25+ (1) comply with:
26+ (A) federal law regarding the confidentiality of
27+ student information, including the Family Educational Rights and
28+ Privacy Act of 1974 (20 U.S.C. Section 1232g); and
29+ (B) any state law relating to the privacy of
30+ student information; and
31+ (2) protect the confidentiality of student
32+ information shared under the data-sharing agreement.
33+ SECTION 2. The Texas Education Agency and the Texas Higher
34+ Education Coordinating Board shall develop and make available the
35+ model agreement required by Section 7.012, Education Code, as added
36+ by this Act, for use beginning with the 2021-2022 school year.
37+ SECTION 3. This Act takes effect immediately if it receives
38+ a vote of two-thirds of all the members elected to each house, as
39+ provided by Section 39, Article III, Texas Constitution. If this
40+ Act does not receive the vote necessary for immediate effect, this
41+ Act takes effect September 1, 2021.
