55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the confidentiality of juvenile justice information.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 58.009, Family Code, is amended by
1010 amending Subsections (a) and (c) and adding Subsections (a-1) and
1111 (c-1) to read as follows:
1212 (a) For purposes of this section, information is
1313 identifiable if the information contains a juvenile offender's name
1414 or other personal identifiers or can, by virtue of sample size or
1515 other factors, be reasonably interpreted as referring to a
1616 particular juvenile offender.
1717 (a-1) Except as provided by this section, identifiable
1818 juvenile justice information collected and maintained by the Texas
1919 Juvenile Justice Department for statistical and research purposes
2020 is confidential information for the use of the department and may
2121 not be disseminated by the department.
2222 (c) The Texas Juvenile Justice Department may grant [the
2323 following entities] access to identifiable juvenile justice
2424 information:
2525 (1) for research and statistical purposes or for any
2626 other purpose approved by the department to:
2727 (A) [(1)] criminal justice agencies as defined
2828 by Section 411.082, Government Code;
2929 (B) [(2)] the Texas Education Agency, as
3030 authorized under Section 37.084, Education Code;
3131 (C) [(3)] any agency under the authority of the
3232 Health and Human Services Commission; or
3333 (D) [(4)] the Department of Family and
3434 Protective Services; or
3535 (2) for a purpose beneficial to and approved by the
3636 department to an individual or entity that:
3737 (A) is working on a research or statistical
3838 project that meets the requirements of and is approved by the
3939 department; and
4040 (B) has a specific agreement with the department
4141 that:
4242 (i) specifically authorizes access to
4343 identifiable juvenile justice information;
4444 (ii) limits the use of the information to
4545 the purposes for which the information is given;
4646 (iii) ensures the security and
4747 confidentiality of the information; and
4848 (iv) provides for sanctions if a
4949 requirement imposed under Subparagraph (i), (ii), or (iii) is
5050 violated [(5) a public or private university].
5151 (c-1) The Texas Juvenile Justice Department shall grant
5252 access to juvenile justice information that is not identifiable
5353 information for research or statistical purposes or for any other
5454 purpose approved by the department to:
5555 (1) criminal justice agencies as defined by Section
5656 411.082, Government Code;
5757 (2) the Texas Education Agency, as authorized under
5858 Section 37.084, Education Code;
5959 (3) any agency under the authority of the Health and
6060 Human Services Commission;
6161 (4) the Department of Family and Protective Services;
6262 (5) a public or private university; or
6363 (6) an individual or entity working on a research or
6464 statistical project.
6565 SECTION 2. Sections 58.009(d), (f), and (g), Family Code,
6666 are repealed.
6767 SECTION 3. This Act takes effect immediately if it receives
6868 a vote of two-thirds of all the members elected to each house, as
6969 provided by Section 39, Article III, Texas Constitution. If this
7070 Act does not receive the vote necessary for immediate effect, this
7171 Act takes effect September 1, 2021.
