66 AN ACT
77 relating to prohibiting certain discrimination based on sexual
88 orientation or gender identity or expression.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Articles 42.014(a) and (c), Code of Criminal
1111 Procedure, are amended to read as follows:
1212 (a) In the trial of an offense under Title 5, Penal Code, or
1313 Section 28.02, 28.03, or 28.08, Penal Code, the judge shall make an
1414 affirmative finding of fact and enter the affirmative finding in
1515 the judgment of the case if at the guilt or innocence phase of the
1616 trial, the judge or the jury, whichever is the trier of fact,
1717 determines beyond a reasonable doubt that the defendant
1818 intentionally selected the person against whom the offense was
1919 committed, or intentionally selected the person's property that was
2020 damaged or affected as a result of the offense, because of the
2121 defendant's bias or prejudice against a group identified by race,
2222 color, disability, religion, national origin or ancestry, age,
2323 gender, [or] sexual orientation, or gender identity or expression
2424 [preference] or by status as a peace officer or judge.
2525 (c) In this article:
2626 (1) "Gender identity or expression" means having or
2727 being perceived as having a gender-related identity, appearance,
2828 expression, or behavior, regardless of whether that identity,
2929 appearance, expression, or behavior is different from that commonly
3030 associated with the person's actual or perceived sex.
3131 (2) "Sexual orientation" means the actual or perceived
3232 status of an individual with respect to the individual's
3333 sexuality[, "sexual preference" has the following meaning only: a
3434 preference for heterosexuality, homosexuality, or bisexuality].
3535 SECTION 2. Section 153.003, Family Code, is amended to read
3636 as follows:
3737 Sec. 153.003. NO DISCRIMINATION BASED ON SEX, SEXUAL
3838 ORIENTATION, GENDER IDENTITY OR EXPRESSION, OR MARITAL STATUS. (a)
3939 The court shall consider the qualifications of the parties without
4040 regard to their marital status, sexual orientation, or gender
4141 identity or expression, or to the sex of the party or the child in
4242 determining:
4343 (1) which party to appoint as sole managing
4444 conservator;
4545 (2) whether to appoint a party as joint managing
4646 conservator; and
4747 (3) the terms and conditions of conservatorship and
4848 possession of and access to the child.
4949 (b) In this section:
5050 (1) "Gender identity or expression" means having or
5151 being perceived as having a gender-related identity, appearance,
5252 expression, or behavior, regardless of whether that identity,
5353 appearance, expression, or behavior is different from that commonly
5454 associated with the person's actual or perceived sex.
5555 (2) "Sexual orientation" means the actual or perceived
5656 status of an individual with respect to the individual's sexuality.
5757 SECTION 3. Section 544.002, Insurance Code, is amended by
5858 amending Subsection (a) and adding Subsection (d) to read as
5959 follows:
6060 (a) A person may not refuse to insure or provide coverage to
6161 an individual, refuse to continue to insure or provide coverage to
6262 an individual, limit the amount, extent, or kind of coverage
6363 available for an individual, or charge an individual a rate that is
6464 different from the rate charged to other individuals for the same
6565 coverage because of the individual's:
6666 (1) race, color, religion, or national origin;
6767 (2) age, gender, marital status, or geographic
6868 location; [or]
6969 (3) disability or partial disability; or
7070 (4) sexual orientation or gender identity or
7171 expression.
7272 (d) In this section:
7373 (1) "Gender identity or expression" means having or
7474 being perceived as having a gender-related identity, appearance,
7575 expression, or behavior, regardless of whether that identity,
7676 appearance, expression, or behavior is different from that commonly
7777 associated with the person's actual or perceived sex.
7878 (2) "Sexual orientation" means the actual or perceived
7979 status of an individual with respect to the individual's sexuality.
8080 SECTION 4. Section 21.002, Labor Code, is amended by adding
8181 Subdivisions (9-a) and (13-a) to read as follows:
8282 (9-a) "Gender identity or expression" means having or
8383 being perceived as having a gender-related identity, appearance,
8484 expression, or behavior, regardless of whether that identity,
8585 appearance, expression, or behavior is different from that commonly
8686 associated with the person's actual or perceived sex.
8787 (13-a) "Sexual orientation" means the actual or
8888 perceived status of an individual with respect to the individual's
8989 sexuality.
9090 SECTION 5. Section 21.051, Labor Code, is amended to read as
9191 follows:
9292 Sec. 21.051. DISCRIMINATION BY EMPLOYER. An employer
9393 commits an unlawful employment practice if because of race, color,
9494 disability, religion, sex, national origin, [or] age, sexual
9595 orientation, or gender identity or expression the employer:
9696 (1) fails or refuses to hire an individual, discharges
9797 an individual, or discriminates in any other manner against an
9898 individual in connection with compensation or the terms,
9999 conditions, or privileges of employment; or
100100 (2) limits, segregates, or classifies an employee or
101101 applicant for employment in a manner that would deprive or tend to
102102 deprive an individual of any employment opportunity or adversely
103103 affect in any other manner the status of an employee.
104104 SECTION 6. Article 42.014, Code of Criminal Procedure, as
105105 amended by this Act, applies only to an offense committed on or
106106 after the effective date of this Act. An offense committed before
107107 the effective date of this Act is governed by the law in effect on
108108 the date the offense was committed, and the former law is continued
109109 in effect for that purpose. For purposes of this section, an offense
110110 was committed before the effective date of this Act if any element
111111 of the offense occurred before that date.
112112 SECTION 7. (a) Section 153.003, Family Code, as amended by
113113 this Act, applies to a suit affecting the parent-child relationship
114114 pending in a trial court on the effective date of this Act or filed
115115 on or after that date.
116116 (b) The enactment of this Act constitutes a material and
117117 substantial change of circumstances sufficient to warrant
118118 modification of a court order or portion of a decree that provides
119119 for conservatorship or possession of or access to a child rendered
120120 before the effective date of this Act.
121121 SECTION 8. Section 544.002, Insurance Code, as amended by
122122 this Act, applies only to a health benefit plan delivered, issued
123123 for delivery, or renewed on or after January 1, 2022. A health
124124 benefit plan delivered, issued for delivery, or renewed before
125125 January 1, 2022, is governed by the law as it existed immediately
126126 before the effective date of this Act, and that law is continued in
127127 effect for that purpose.
128128 SECTION 9. Section 21.051, Labor Code, as amended by this
129129 Act, applies to conduct occurring on or after the effective date of
130130 this Act. Conduct occurring before that date is governed by the law
131131 in effect on the date the conduct occurred, and the former law is
132132 continued in effect for that purpose.
133133 SECTION 10. This Act takes effect September 1, 2021.
