44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the special education allotment.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Sections 48.102(a) and (j), Education Code, are
99 amended to read as follows:
1010 (a) For each student [in average daily attendance] in a
1111 special education program under Subchapter A, Chapter 29, in a
1212 mainstream instructional arrangement, a school district is
1313 entitled to an annual allotment equal to the basic allotment, or, if
1414 applicable, the sum of the basic allotment and the allotment under
1515 Section 48.101 to which the district is entitled, multiplied by
1616 1.15. For each full-time equivalent student [in average daily
1717 attendance] in a special education program under Subchapter A,
1818 Chapter 29, in an instructional arrangement other than a mainstream
1919 instructional arrangement, a district is entitled to an annual
2020 allotment equal to the basic allotment, or, if applicable, the sum
2121 of the basic allotment and the allotment under Section 48.101 to
2222 which the district is entitled, multiplied by a weight determined
2323 according to instructional arrangement as follows:

3434 (j) A school district that provides an extended year program
3535 required by federal law for special education students who may
3636 regress is entitled to receive funds in an amount equal to 75
3737 percent, or a lesser percentage determined by the commissioner, of
3838 the basic allotment, or, if applicable, the sum of the basic
3939 allotment and the allotment under Section 48.101 to which the
4040 district is entitled for each full-time equivalent student [in
4141 average daily attendance], multiplied by the amount designated for
4242 the student's instructional arrangement under this section[, for
4343 each day the program is provided divided by the number of days in
4444 the minimum school year]. The total amount of state funding for
4545 extended year services under this section may not exceed $10
4646 million per year. A school district may use funds received under
4747 this section only in providing an extended year program.
4848 SECTION 2. This Act takes effect September 1, 2021.
