| 10 | 10 | SECTION 1. This Act may be cited as the Esequiel Mendoza | |
| 11 | 11 | Act. | |
| 12 | 12 | SECTION 2. Subchapter B, Chapter 251, Health and Safety | |
| 13 | 13 | Code, is amended by adding Section 251.016 to read as follows: | |
| 14 | 14 | Sec. 251.016. EMERGENCY GENERATOR OR OTHER POWER SOURCE. | |
| 15 | 15 | Each end stage renal disease facility licensed under this chapter | |
| 16 | 16 | shall ensure the facility is equipped with an operational emergency | |
| 17 | 17 | generator or comparable emergency power source and a sufficient | |
| 18 | 18 | amount of fuel to operate the generator or power source during a | |
| 19 | 19 | power outage. | |
| 20 | 20 | SECTION 3. As soon as practicable after the effective date | |
| 21 | 21 | of this Act, the executive commissioner of the Health and Human | |
| 22 | 22 | Services Commission shall adopt rules necessary to implement | |
| 23 | 23 | Section 251.016, Health and Safety Code, as added by this Act. | |
| 24 | 24 | SECTION 4. This Act takes effect September 1, 2021. |
