55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the composition of the port commission of the Port of
88 Corpus Christi Authority of Nueces County, Texas.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 5016.0052(a), Special District Local
1111 Laws Code, as effective April 1, 2021, is amended to read as
1212 follows:
1313 (a) Port commissioners are appointed as follows:
1414 (1) the commissioners court [Commissioners Court] of
1515 Nueces County shall appoint two [three] port commissioners;
1616 (2) the city council of the City of Corpus Christi
1717 shall appoint three port commissioners; and
1818 (3) the commissioners court [Commissioners Court] of
1919 San Patricio County shall appoint two [one] port commissioners
2020 [commissioner].
2121 SECTION 2. The change in law made by this Act does not
2222 affect the term of a port commissioner of the port commission of the
2323 Port of Corpus Christi Authority of Nueces County, Texas, serving
2424 on the effective date of this Act. Port commissioners appointed to
2525 fill vacancies occurring on or after the effective date of this Act
2626 must be appointed in accordance with Section 2(a), Chapter 397,
2727 Acts of the 68th Legislature, Regular Session, 1983, as amended by
2828 this Act.
2929 SECTION 3. (a) The legal notice of the intention to
3030 introduce this Act, setting forth the general substance of this
3131 Act, has been published as provided by law, and the notice and a
3232 copy of this Act have been furnished to all persons, agencies,
3333 officials, or entities to which they are required to be furnished
3434 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
3535 Government Code.
3636 (b) The governor, one of the required recipients, has
3737 submitted the notice and Act to the Texas Commission on
3838 Environmental Quality.
3939 (c) The Texas Commission on Environmental Quality has filed
4040 its recommendations relating to this Act with the governor, the
4141 lieutenant governor, and the speaker of the house of
4242 representatives within the required time.
4343 (d) All requirements of the constitution and laws of this
4444 state and the rules and procedures of the legislature with respect
4545 to the notice, introduction, and passage of this Act are fulfilled
4646 and accomplished.
4747 SECTION 4. This Act takes effect immediately if it receives
4848 a vote of two-thirds of all the members elected to each house, as
4949 provided by Section 39, Article III, Texas Constitution. If this
5050 Act does not receive the vote necessary for immediate effect, this
5151 Act takes effect September 1, 2021.
