97 relating to education and training for peace officers on
108 interacting with persons with Alzheimer's disease and other
119 dementias.
1210 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
13- SECTION 1. Section 1701.253(j), Occupations Code, is
14- amended to read as follows:
15- (j) As part of the minimum curriculum requirements, the
16- commission shall require an officer to complete a 40-hour statewide
17- education and training program on de-escalation and crisis
18- intervention techniques to facilitate interaction with persons
19- with mental impairments. The program must include instruction on
20- interacting with persons with Alzheimer's disease and other
21- dementias, including instruction on techniques for recognizing
22- symptoms, communicating effectively, employing alternatives to
23- physical restraints, and identifying signs of abuse, neglect, or
24- exploitation. An officer shall complete the program not later than
25- the second anniversary of the date the officer is licensed under
26- this chapter or the date the officer applies for an intermediate
27- proficiency certificate, whichever date is earlier. An officer may
28- not satisfy the requirements of this subsection or Section
29- 1701.402(g) by taking an online course on de-escalation and crisis
30- intervention techniques to facilitate interaction with persons
31- with mental impairments.
32- SECTION 2. Not later than April 1, 2022, the Texas
33- Commission on Law Enforcement shall revise the commission's
34- education and training programs as necessary to implement the
35- changes in law made by this Act.
36- SECTION 3. Section 1701.253(j), Occupations Code, as
37- amended by this Act, applies only to a person who submits an
38- application for a peace officer license under Chapter 1701,
39- Occupations Code, on or after April 1, 2022. A person who submits
40- an application for a peace officer license under Chapter 1701,
41- Occupations Code, before April 1, 2022, is governed by the law in
42- effect immediately before the effective date of this Act, and the
43- former law is continued in effect for that purpose.
11+ SECTION 1. Section 1701.253, Occupations Code, is amended
12+ by adding Subsection (q) to read as follows:
13+ (q) As part of the minimum curriculum requirements, the
14+ commission shall require an officer to complete a four-hour
15+ statewide education and training program developed by the
16+ commission on techniques to facilitate interaction with persons
17+ with Alzheimer's disease and other dementias, including techniques
18+ for recognizing symptoms, communicating effectively, employing
19+ alternatives to physical restraints, and identifying signs of
20+ abuse, neglect, or exploitation.
21+ SECTION 2. Not later than January 1, 2022, the Texas
22+ Commission on Law Enforcement shall establish the education and
23+ training program required by Section 1701.253(q), Occupations
24+ Code, as added by this Act.
25+ SECTION 3. Section 1701.253(q), Occupations Code, as added
26+ by this Act, applies only to a person who submits an application for
27+ a peace officer license under Chapter 1701, Occupations Code, on or
28+ after January 1, 2022. A person who submits an application for a
29+ peace officer license under Chapter 1701, Occupations Code, before
30+ January 1, 2022, is governed by the law in effect immediately before
31+ the effective date of this Act, and the former law is continued in
32+ effect for that purpose.
4433 SECTION 4. This Act takes effect September 1, 2021.
