66 AN ACT
77 relating to the administration of public school assessment
88 instruments and the temporary suspension of certain accountability
99 determinations for a school district or campus in a school year in
1010 which in-person attendance at the district is disrupted as a result
1111 of a declared disaster and the requirement to use those assessment
1212 instruments as a criterion for promotion or graduation of a public
1313 school student.
1414 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1515 SECTION 1. Subchapter B, Chapter 39, Education Code, is
1616 amended by adding Section 39.0239 to read as follows:
1717 Sec. 39.0239. ADMINISTRATION OF ASSESSMENT INSTRUMENTS AND
1818 TEMPORARY SUSPENSION OF CERTAIN ACCOUNTABILITY MEASURES DURING
1919 DISASTER. (a) If a school district is located wholly or partly in
2020 the area of a disaster declared by the president of the United
2121 States under the Robert T. Stafford Disaster Relief and Emergency
2222 Assistance Act (42 U.S.C. Section 5121 et seq.) or by the governor
2323 under Chapter 418, Government Code, during a school year in which
2424 in-person attendance at the district is disrupted for at least
2525 37,800 instructional minutes as a result of the disaster, the
2626 commissioner shall apply to the United States Department of
2727 Education for a waiver of the requirement under the Every Student
2828 Succeeds Act (20 U.S.C. Section 6301 et seq.) to administer
2929 assessment instruments during that school year for the affected
3030 district.
3131 (b) If the United States Department of Education fails to
3232 grant a waiver requested under Subsection (a), the assessment
3333 instruments shall be administered as required under Section 39.023
3434 during the applicable school year, but, notwithstanding any other
3535 law, the commissioner may not consider the results of the
3636 assessment instruments for purposes of:
3737 (1) evaluating school district or campus performance
3838 under this chapter for the affected district for the applicable
3939 school year, including in determining:
4040 (A) the accreditation status of a district under
4141 Section 39.051;
4242 (B) the performance rating to assign to the
4343 district or the district's campuses under Section 39.054; or
4444 (C) whether to impose any intervention or
4545 sanction authorized by Chapter 39A after the applicable school year
4646 on the district or the district's campuses; or
4747 (2) determining a student's qualification for
4848 promotion or graduation.
4949 SECTION 2. This Act takes effect immediately if it receives
5050 a vote of two-thirds of all the members elected to each house, as
5151 provided by Section 39, Article III, Texas Constitution. If this
5252 Act does not receive the vote necessary for immediate effect, this
5353 Act takes effect September 1, 2021.
