6	6	AN ACT
7	7	relating to the regulation of nurse aides; requiring an
8	8	occupational registration.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 250.001, Health and Safety Code, is
11	11	amended by adding Subdivisions (6) and (7) to read as follows:
12	12	(6) "Commission" means the Health and Human Services
13	13	Commission.
14	14	(7) "Executive commissioner" means the executive
15	15	commissioner of the commission.
16	16	SECTION 2. Section 250.0035, Health and Safety Code, is
17	17	amended to read as follows:
18	18	Sec. 250.0035. CERTIFICATE OF REGISTRATION; REQUIREMENTS
19	19	FOR INCLUSION IN NURSE AIDE REGISTRY [TRAINING REQUIREMENTS;
20	20	CONTINUING EDUCATION]. (a) To be listed on the nurse aide
21	21	registry, an applicant must:
22	22	(1) complete a training program approved by the
23	23	commission [Department of Aging and Disability Services] that
24	24	includes:
25	25	(A) [(1)] not less than 100 hours of course work
26	26	as specified by rule; and
27	27	(B) [(2)] a competency evaluation on completion
28	28	of the training program; and
29	29	(2) hold a certificate of registration issued by the
30	30	commission on completion of the training program required under
31	31	Subdivision (1).
32	32	(b) A certificate of registration and listing on the nurse
33	33	aide registry expire [expires] on the second anniversary of the
34	34	date the certificate is issued and the nurse aide is listed in the
35	35	registry [of the listing].
36	36	(c) To renew a nurse aide's certificate of registration and
37	37	listing on the registry, the nurse aide must complete at least 24
38	38	hours of in-service education every two years, including training
39	39	in geriatrics and, if applicable, in the care of patients with
40	40	Alzheimer's disease.
41	41	(d) The executive commissioner [of the Health and Human
42	42	Services Commission] shall adopt the rules [as] necessary to
43	43	implement this section, including rules for the issuance and
44	44	renewal of a certificate of registration under this section and the
45	45	regulation of nurse aides as necessary to protect the public health
46	46	and safety.
47	47	SECTION 3. (a) As soon as practicable after the effective
48	48	date of this Act, the executive commissioner of the Health and Human
49	49	Services Commission shall adopt the rules and procedures necessary
50	50	to implement Section 250.0035, Health and Safety Code, as amended
51	51	by this Act.
52	52	(b) Notwithstanding Section 250.0035, Health and Safety
53	53	Code, as amended by this Act, a nurse aide is not required to hold a
54	54	certificate of registration issued under that section until
55	55	September 1, 2022.
56	56	SECTION 4. This Act takes effect September 1, 2021.
