55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to plot plan requirements for an application for a
88 standard permit for a concrete batch plant issued by the Texas
99 Commission on Environmental Quality.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 382.05195, Health and Safety Code, is
1212 amended by adding Subsection (k) to read as follows:
1313 (k) An application for the issuance of a standard permit
1414 under this section for a concrete plant that performs wet batching,
1515 dry batching, or central mixing, including a permanent, temporary,
1616 or specialty concrete batch plant, as defined by the commission,
1717 must include a plot plan that clearly shows:
1818 (1) a distance scale;
1919 (2) a north arrow;
2020 (3) all property lines, emission points, buildings,
2121 tanks, and process vessels and other process equipment in the area
2222 in which the facility will be located;
2323 (4) at least two benchmark locations in the area in
2424 which the facility will be located; and
2525 (5) if the permit requires a distance, setback, or
2626 buffer from other property or structures as a condition of the
2727 permit, whether the required distance or setback will be met.
2828 SECTION 2. Section 382.05198, Health and Safety Code, is
2929 amended by adding Subsection (c) to read as follows:
3030 (c) An application for the issuance of a standard permit
3131 under this section must include a plot plan that meets the
3232 requirements of Section 382.05195(k).
3333 SECTION 3. The changes in law made by this Act apply only to
3434 an application for a standard permit described by Section 382.05195
3535 or 382.05198, Health and Safety Code, that is filed with the Texas
3636 Commission on Environmental Quality on or after the effective date
3737 of this Act. An application for a standard permit filed before the
3838 effective date of this Act is governed by the law in effect on the
3939 date of filing, and that law is continued in effect for that
4040 purpose.
4141 SECTION 4. This Act takes effect September 1, 2021.
