| 9 | 9 | | Commission on Environmental Quality. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 382.05195, Health and Safety Code, is |
|---|
| 12 | 12 | | amended by adding Subsection (k) to read as follows: |
|---|
| 13 | 13 | | (k) An application for the issuance of a standard permit |
|---|
| 14 | 14 | | under this section for a concrete plant that performs wet batching, |
|---|
| 15 | 15 | | dry batching, or central mixing, including a permanent, temporary, |
|---|
| 16 | 16 | | or specialty concrete batch plant, as defined by the commission, |
|---|
| 17 | 17 | | must include a plot plan that clearly shows: |
|---|
| 18 | 18 | | (1) a distance scale; |
|---|
| 19 | 19 | | (2) a north arrow; |
|---|
| 20 | 20 | | (3) all property lines, emission points, buildings, |
|---|
| 21 | 21 | | tanks, and process vessels and other process equipment in the area |
|---|
| 22 | 22 | | in which the facility will be located; |
|---|
| 23 | 23 | | (4) at least two benchmark locations in the area in |
|---|
| 24 | 24 | | which the facility will be located; and |
|---|
| 25 | 25 | | (5) if the permit requires a distance, setback, or |
|---|
| 26 | 26 | | buffer from other property or structures as a condition of the |
|---|
| 27 | 27 | | permit, whether the required distance or setback will be met. |

| 28 | 28 | | SECTION 2. Section 382.05198, Health and Safety Code, is |
|---|
| 29 | 29 | | amended by adding Subsection (c) to read as follows: |
|---|
| 30 | 30 | | (c) An application for the issuance of a standard permit |
|---|
| 31 | 31 | | under this section must include a plot plan that meets the |
|---|
| 32 | 32 | | requirements of Section 382.05195(k). |
|---|
| 33 | 33 | | SECTION 3. The changes in law made by this Act apply only to |
|---|
| 34 | 34 | | an application for a standard permit described by Section 382.05195 |
|---|
| 35 | 35 | | or 382.05198, Health and Safety Code, that is filed with the Texas |
|---|
| 36 | 36 | | Commission on Environmental Quality on or after the effective date |
|---|
| 37 | 37 | | of this Act. An application for a standard permit filed before the |
|---|
| 38 | 38 | | effective date of this Act is governed by the law in effect on the |
|---|
| 39 | 39 | | date of filing, and that law is continued in effect for that |
|---|
| 40 | 40 | | purpose. |

| 41 | 41 | | SECTION 4. This Act takes effect September 1, 2021. |
