55 AN ACT
66 relating to the transfer of the Health and Human Services function
77 of regulating facilities and family homes under Chapter 42, Human
88 Resources Code, to the Department of Family and Protective
99 Services.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. (a) Section 531.0084, Government Code is
1212 deleted and (b) Sections 531.02011 and 531.02013, Government Code,
1313 are amended to read as follows:
1414 Sec. 531.0084. INVESTIGATION UNIT FOR ILLEGALLY OPERATING
1515 CHILD-CARE FACILITIES. The executive commissioner shall maintain a
1616 unit within the child-care licensing division of the commission
1717 consisting of investigators whose primary responsibility is to:
1818 (1) identify child-care facilities that are operating
1919 without a license, certification, registration, or listing
2020 required by Chapter 42, Human Resources Code; and
2121 (2) initiate appropriate enforcement actions against
2222 those facilities.
2323 Sec. 531.02011. PHASE TWO: FINAL TRANSFERS TO COMMISSION.
2424 (a) On the dates specified in the transition plan required under
2525 Section 531.0204, the following functions are transferred to the
2626 commission as provided by this subchapter:
2727 (1) all functions of each state agency and entity
2828 subject to abolition under Section 531.0202(b) that remained with
2929 the agency or entity after the initial transfer of functions under
3030 Section 531.0201 or a transfer of administrative support services
3131 functions under Section 531.02012;
3232 (2) regulatory functions and functions related to
3333 state-operated institutions of the Department of State Health
3434 Services; and
3535 (3) regulatory functions of the Department of Family
3636 and Protective Services.
3737 (b) Notwithstanding Subdivision (a)(3) of this section, the
3838 function of regulating facilities and family homes under Chapter
3939 42, Human Resources Code, will be performed by the Department of
4040 Family and Protective Services effective September 1, 2021 as
4141 provided in Section 531.02013(b). As soon as possible after the
4242 effective date of this Act, the Commission shall transfer any and
4343 all Commission funds, staff, and resources necessary for the
4444 Department of Family and Protective Services to assume the function
4545 of regulating facilities and family homes under Chapter 42, Human
4646 Resources Code.
4747 Sec. 531.02013. FUNCTIONS REMAINING WITH CERTAIN AGENCIES.
4848 (a) The following functions are not subject to transfer under
4949 Sections 531.0201 and 531.02011:
5050 (1) the functions of the Department of Family and
5151 Protective Services, including the statewide intake of reports and
5252 other information, related to the following:
5353 (A) child protective services, including
5454 services that are required by federal law to be provided by this
5555 state's child welfare agency;
5656 (B) adult protective services, other than
5757 investigations of the alleged abuse, neglect, or exploitation of an
5858 elderly person or person with a disability:
5959 (i) in a facility operated, or in a facility
6060 or by a person licensed, certified, or registered, by a state
6161 agency; or
6262 (ii) by a provider that has contracted to
6363 provide home and community-based services;
6464 (C) prevention and early intervention services;
6565 and
6666 (D) investigations of alleged abuse, neglect, or
6767 exploitation occurring at a child-care facility, as that term is
6868 defined in Section 40.042, Human Resources Code; and
6969 (2) the public health functions of the Department of
7070 State Health Services, including health care data collection and
7171 maintenance of the Texas Health Care Information Collection
7272 program.
7373 (b) Effective September 1, 2021, the function of regulating
7474 facilities and family homes under Chapter 42, Human Resources Code,
7575 will be transferred to the Department of Family and Protective
7676 Services.
7777 Sec. 531.951. APPLICABILITY. (a) This subchapter applies
7878 only to the final licensing, listing, or registration decisions of
7979 a health and human services agency with respect to a person under
8080 the law authorizing the agency to regulate the following types of
8181 persons:
8282 (1) a youth camp licensed under Chapter 141, Health
8383 and Safety Code;
8484 (2) a home and community support services agency
8585 licensed under Chapter 142, Health and Safety Code;
8686 (3) a hospital licensed under Chapter 241, Health and
8787 Safety Code;
8888 (4) an institution licensed under Chapter 242, Health
8989 and Safety Code;
9090 (5) an assisted living facility licensed under Chapter
9191 247, Health and Safety Code;
9292 (6) a special care facility licensed under Chapter
9393 248, Health and Safety Code;
9494 (7) an intermediate care facility licensed under
9595 Chapter 252, Health and Safety Code;
9696 (8) a chemical dependency treatment facility licensed
9797 under Chapter 464, Health and Safety Code;
9898 (9) a mental hospital or mental health facility
9999 licensed under Chapter 577, Health and Safety Code;
100100 (10) a child-care facility or child-placing agency
101101 licensed under or a family home listed or registered under Chapter
102102 42, Human Resources Code; or
103103 (1011) a day activity and health services facility
104104 licensed under Chapter 103, Human Resources Code.
105105 (b) This subchapter does not apply to an agency decision
106106 that did not result in a final order or that was reversed on appeal.
107107 SECTION 2. Sections 40.0025, 40.042, and 40.0505, Human
108108 Resources Code, are amended to read as follows:
109109 Sec. 40.0025. AGENCY FUNCTIONS. (a) In this section,
110110 "function" includes a power, duty, program, or activity and an
111111 administrative support services function associated with the
112112 power, duty, program, or activity, unless consolidated under
113113 Section 531.02012, Government Code.
114114 (b) In accordance with Subchapter A-1, Chapter 531,
115115 Government Code, and notwithstanding any other law, the department
116116 performs only functions, including the statewide intake of reports
117117 and other information, related to the following services:
118118 (1) child protective services, including services
119119 that are required by federal law to be provided by this state's
120120 child welfare agency;
121121 (2) adult protective services, other than
122122 investigations of the alleged abuse, neglect, or exploitation of an
123123 elderly person or person with a disability:
124124 (A) in a facility operated, or in a facility or by
125125 a person licensed, certified, or registered, by a state agency; or
126126 (B) by a provider that has contracted to provide
127127 home and community-based services; and
128128 (3) prevention and early intervention services
129129 functions, including:
130130 (A) prevention and early intervention services
131131 as defined under Section 265.001, Family Code; and
132132 (B) programs that:
133133 (i) provide parent education;
134134 (ii) promote healthier parent-child
135135 relationships; or
136136 (iii) prevent family violence; and
137137 (4) services related to regulation of facilities and
138138 family homes under Chapter 42, Human Resources Code.
139139 Sec. 40.042. INVESTIGATIONS OF CHILD ABUSE, NEGLECT, AND
140140 EXPLOITATION. (a) In this section, "child-care facility" includes
141141 a facility, licensed or unlicensed child-care facility, family
142142 home, residential child-care facility, employer-based day-care
143143 facility, or shelter day-care facility regulated by the department,
144144 as those terms are defined in Chapter 42.
145145 (b) For all investigations of child abuse, neglect, or
146146 exploitation conducted by the child protective investigations
147147 services division of the department, the department shall adopt the
148148 definitions of abuse, neglect, and exploitation provided in Section
149149 261.001, Family Code.
150150 (c) The department shall establish standardized policies to
151151 be used during investigations.
152152 (d) The commissioner shall establish units within the child
153153 protective investigationsservices division of the department to
154154 specialize in investigating allegations of child abuse, neglect, or
155155 exploitation occurring at a child-care facility.
156156 (e) The department may require that investigators who
157157 specialize in allegations of child abuse, neglect, and exploitation
158158 occurring at child-care facilities receive ongoing training on the
159159 minimum licensing standards for any facilities that are applicable
160160 to the investigator's specialization.
161161 (f) Upon initiation ofAfter an investigation by the child
162162 protective investigations division of the department of abuse,
163163 neglect, or exploitation occurring at a child-care facility, the
164164 child protective investigations divisiondepartment shall
165165 collaborate and share case information with the division of the
166166 department responsibleprovide the state agency responsible for
167167 regulating the facility in order for the regulatory division to
168168 conduct related inspections and non-abuse, neglect, or
169169 exploitation investigationswith access to any information
170170 relating to the department's investigation. Providing access to
171171 confidential information under this subsection does not constitute
172172 a waiver of confidentiality.
173173 (g) The executive commissioner or the commissioner of the
174174 department, as appropriate, may adopt rules to implement this
175175 section.
176176 Sec. 40.0505. DIVISIONS OF DEPARTMENT. (a) The
177177 commissioner shall establish the following divisions and offices
178178 within the department:
179179 (1) an investigations division;
180180 (2) a consolidated data division;
181181 (3) a legal division that oversees the following:
182182 (A) legal matters relating to human resources, as
183183 necessary to manage the department's workforce and establish the
184184 department's hiring and termination policies;
185185 (B) open records;
186186 (C) privacy and confidentiality;
187187 (D) litigation; and
188188 (E) contract compliance;
189189 (4) an operations division that oversees department
190190 operations and human resources functions of the department; and
191191 (5) a financial management and accounting services
192192 division;
193193 (6) a regulatory division to perform the function of
194194 overseeing and regulating facilities and family homes under Chapter
195195 42.
196196 (b) The commissioner may establish additional divisions
197197 within the department as the commissioner determines appropriate.
198198 (c) The commissioner may assign department functions among
199199 the department's divisions.
200200 SECTION 3. Sections 42.00311, Human Resources Code, is
201201 added and 42.0211, Human Resources Code, is amended to read as
202202 follows:
203203 Sec. 42.00311. REFERENCES IN LAW MEANING DEPARTMENT OR
204204 DEPARTMENT COMMISSIONER. In this chapter, a reference to the
205205 department or the commission means the Department of Family and
206206 Protective Services. A reference to the commissioner or executive
207207 commissioner means the commissioner of the Department of Family and
208208 Protective Services.
209209 Sec. 42.0211. SAFETY SPECIALISTS, RISK ANALYSTS, AND
210210 PERFORMANCE MANAGEMENT, AND UNIT FOR ILLEGALLY OPERATING
211211 CHILD-CARE FACILITIES. (a) The division shall employ at least one
212212 specially trained investigation safety specialist, whose duties
213213 include the duty to:
214214 (1) review and evaluate the intake of reports that
215215 include allegations associated with a higher risk of harm to the
216216 child; and
217217 (2) consult with the assigned investigator to provide
218218 specialized guidance and resources to assist the investigation.
219219 (b) The division shall employ at least one risk analyst,
220220 whose duties include the duty to:
221221 (1) identify facilities, including child-placing
222222 agencies, whose compliance histories indicate the potential for a
223223 higher risk of harm to children in the care of the facility;
224224 (2) review the monitoring and inspection reports for
225225 any facilities described by Subdivision (1) to assess the quality
226226 of the investigation or monitoring; and
227227 (3) identify any additional monitoring or enforcement
228228 action that may be appropriate to ensure the safety of a child in
229229 the care of the facility.
230230 (c) The division must include a performance management unit
231231 with duties that include:
232232 (1) conducting quality assurance reviews of randomly
233233 selected monitoring and investigative reports to ensure compliance
234234 with all relevant laws, rules, and agency policies; and
235235 (2) making recommendations to improve the quality and
236236 consistency of monitoring and investigations.
237237 (d) The division must include a unit consisting of
238238 investigators whose primary responsibility is to:
239239 (1) identify child-care facilities that are operating
240240 without a license, certification, registration, or listing
241241 required by this Chapter; and
242242 (2) initiate appropriate enforcement actions against
243243 those facilities.
244244 SECTION 4. This Act takes effect September 1, 2021.
