9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 481.003(b), Health and Safety Code, is | |
11 | 11 | amended to read as follows: | |
12 | 12 | (b) The director by rule shall prohibit a person in this | |
13 | 13 | state, including a person regulated by the Texas Department of | |
14 | 14 | Insurance under the Insurance Code or the other insurance laws of | |
15 | 15 | this state, a state licensing authority, and a person in the course | |
16 | 16 | of the person's employment as a pharmacist, from using a | |
17 | 17 | practitioner's Federal Drug Enforcement Administration number for | |
18 | 18 | a purpose other than a purpose described by federal law or by this | |
19 | 19 | chapter. A person who violates a rule adopted under this subsection | |
20 | 20 | commits a Class C misdemeanor. | |
21 | 21 | SECTION 2. The change in law made by this Act applies only | |
22 | 22 | to an offense committed on or after the effective date of this Act. | |
23 | 23 | An offense committed before the effective date of this Act is | |
24 | 24 | governed by the law in effect on the date the offense was committed, | |
25 | 25 | and the former law is continued in effect for that purpose. For | |
26 | 26 | purposes of this section, an offense was committed before the | |
27 | 27 | effective date of this Act if any element of the offense occurred | |
28 | 28 | before that date. | |
29 | 29 | SECTION 3. This Act takes effect September 1, 2021. |
