66 AN ACT
77 relating to the prohibited use of a Federal Drug Enforcement
88 Administration number.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 481.003(b), Health and Safety Code, is
1111 amended to read as follows:
1212 (b) The director by rule shall prohibit a person in this
1313 state, including a person regulated by the Texas Department of
1414 Insurance under the Insurance Code or the other insurance laws of
1515 this state, a state licensing authority, and a person in the course
1616 of the person's employment as a pharmacist, from using a
1717 practitioner's Federal Drug Enforcement Administration number for
1818 a purpose other than a purpose described by federal law or by this
1919 chapter. A person who violates a rule adopted under this subsection
2020 commits a Class C misdemeanor.
2121 SECTION 2. The change in law made by this Act applies only
2222 to an offense committed on or after the effective date of this Act.
2323 An offense committed before the effective date of this Act is
2424 governed by the law in effect on the date the offense was committed,
2525 and the former law is continued in effect for that purpose. For
2626 purposes of this section, an offense was committed before the
2727 effective date of this Act if any element of the offense occurred
2828 before that date.
2929 SECTION 3. This Act takes effect September 1, 2021.
