| 10 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 12 | | SECTION 1. Section 315.002, Labor Code, is amended by |
|---|
| 12 | 13 | | adding Subsection (b-1) to read as follows: |
|---|
| 13 | 14 | | (b-1) To the extent permitted under federal law, the |
|---|
| 14 | 15 | | commission by rule shall establish: |
|---|
| 15 | 16 | | (1) annual performance requirements that each entity |
|---|
| 16 | 17 | | that receives money appropriated under this chapter must satisfy to |
|---|
| 17 | 18 | | qualify for a continuing award of funds under this chapter, which |
|---|
| 18 | 19 | | must include the achievement of enrollment targets and performance |
|---|
| 19 | 20 | | benchmarks that are comparable to those provided by Section |
|---|
| 20 | 21 | | 315.007(c); and |
|---|
| 21 | 22 | | (2) a process for giving priority in awarding funds |
|---|
| 22 | 23 | | under this chapter to entities that consistently satisfy the annual |
|---|
| 23 | 24 | | performance requirements established under Subdivision (1). |
|---|
| 24 | 25 | | SECTION 2. This Act takes effect September 1, 2021. |
