9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Article 42A.408, Code of Criminal Procedure, is | |
11 | 11 | amended by adding Subsection (i) to read as follows: | |
12 | 12 | (i) A defendant ordered to install an interlock device as a | |
13 | 13 | condition of community supervision shall have the ability to choose | |
14 | 14 | from among any interlock provider approved by the Department of | |
15 | 15 | Public Safety as provided by subsection (g) of this section. | |
16 | 16 | SECTION 2. The Department of Public Safety shall publish a | |
17 | 17 | list of approved ignition interlock devices as required by Article | |
18 | 18 | 42A.408(g-1), Code of Criminal Procedure, as added by this Act, not | |
19 | 19 | later than December 1, 2021. | |
20 | 20 | SECTION 3. The change in law made by this Act applies only | |
21 | 21 | to a defendant placed on community supervision on or after January | |
22 | 22 | 23 1, 2021. | |
23 | 23 | SECTION 4. This Act takes effect September 1, 2021. |
