9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. STUDY ON COMPREHENSIVE DEVELOPMENT AGREEMENTS. | |
11 | 11 | (a) In this Act: | |
12 | 12 | (1) "Comprehensive development agreement" has the | |
13 | 13 | meaning assigned by Section 223.201, Transportation Code. | |
14 | 14 | (2) "Department" means the Texas Department of | |
15 | 15 | Transportation. | |
16 | 16 | (3) "Institute" means the Texas A&M Transportation | |
17 | 17 | Institute. | |
18 | 18 | (b) The institute, in consultation with the department, | |
19 | 19 | shall conduct a study on comprehensive development agreements | |
20 | 20 | entered into for transportation projects in this state. The study | |
21 | 21 | must include an analysis of: | |
22 | 22 | (1) the contract provisions in comprehensive | |
23 | 23 | development agreements relating to maintenance and safety; and | |
24 | 24 | (2) the responsibilities of each party to the | |
25 | 25 | comprehensive development agreements relating to maintenance and | |
26 | 26 | safety. | |
27 | 27 | SECTION 2. REPORT. Not later than December 1, 2022, the | |
28 | 28 | institute shall submit a report containing the results of the study | |
29 | 29 | conducted under Section 1 of this Act to the members of the | |
30 | 30 | legislature. | |
31 | 31 | SECTION 3. EXPIRATION. This Act expires January 1, 2023. | |
32 | 32 | SECTION 4. EFFECTIVE DATE. This Act takes effect September | |
33 | 33 | 1, 2021. |
