66 AN ACT
77 relating to program accessibility for female inmates of the Texas
88 Department of Criminal Justice.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 501.026, Government Code, as added by
1111 Chapter 1163 (H.B. 3227), Acts of the 86th Legislature, Regular
1212 Session, 2019, is amended to read as follows:
1313 Sec. 501.026. ACCESS TO PROGRAMS BY FEMALE INMATES. (a)
1414 The department shall develop and implement policies that increase
1515 and promote a female inmate's access to programs, including
1616 parenting classes and educational, vocational, substance use
1717 treatment, rehabilitation, life skills training, and prerelease
1818 programs, offered to inmates in the custody of the department,
1919 including programs offered to defendants confined in state jail
2020 felony facilities [including educational, vocational, substance
2121 use treatment, rehabilitation, life skills training, and
2222 prerelease programs]. The department may not reduce or limit a male
2323 inmate's access to a program to meet the requirements of this
2424 section.
2525 (b) The department shall develop and implement policies
2626 that:
2727 (1) require each facility to make the programs
2828 described by Subsection (a) available and accessible to a female
2929 inmate not later than the 45th day after the date the inmate arrives
3030 at the facility; and
3131 (2) ensure female inmates have access to the same
3232 program opportunities, including master's level education courses,
3333 that are available to male inmates.
3434 (c) Not later than December 31 of each year, the department
3535 shall:
3636 (1) prepare and submit to the governor, the lieutenant
3737 governor, the speaker of the house of representatives, each
3838 standing committee of the legislature having primary jurisdiction
3939 over the department, and the reentry task force described by
4040 Section 501.098 a written report that includes:
4141 (A) a description of any department policies that
4242 were created, modified, or eliminated during the preceding year to
4343 meet the requirements of this section; and
4444 (B) a list of programs available to female
4545 inmates in the custody of the department during the preceding year;
4646 and
4747 (2) publish the report on the department's Internet
4848 website.
4949 SECTION 2. As soon as practicable after the effective date
5050 of this Act, the Texas Department of Criminal Justice shall develop
5151 and implement the policies necessary to implement the changes in
5252 law made by this Act.
5353 SECTION 3. This Act takes effect September 1, 2021.
