| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter B, Chapter 2259, Government Code, is |
|---|
| 11 | 11 | | amended by adding Section 2259.038 to read as follows: |
|---|
| 12 | 12 | | Sec. 2259.038. REGISTRATION AND ANNUAL FILING REQUIRED. |
|---|
| 13 | 13 | | (a) In this section, "department" means the Texas Department of |
|---|
| 14 | 14 | | Insurance. |
|---|
| 15 | 15 | | (b) A governmental unit that establishes a self-insurance |
|---|
| 16 | 16 | | fund under this subchapter shall: |
|---|
| 17 | 17 | | (1) register the fund with the department on a form |
|---|
| 18 | 18 | | prescribed by the commissioner of insurance; and |
|---|
| 19 | 19 | | (2) annually file with the department: |
|---|
| 20 | 20 | | (A) the fund's annual financial statements; |
|---|
| 21 | 21 | | (B) the fund's articles of incorporation; and |
|---|
| 22 | 22 | | (C) any other information requested by the |
|---|
| 23 | 23 | | department. |
|---|
| 24 | 24 | | SECTION 2. Not later than January 1, 2022, the commissioner |
|---|
| 25 | 25 | | of insurance shall prescribe the registration form required by |
|---|
| 26 | 26 | | Section 2259.038, Government Code, as added by this Act. |
|---|
| 27 | 27 | | SECTION 3. A governmental unit is not required to comply |
|---|
| 28 | 28 | | with Section 2259.038, Government Code, as added by this Act, until |
|---|
| 29 | 29 | | January 1, 2022. |
|---|
| 30 | 30 | | SECTION 4. This Act takes effect September 1, 2021. |
