55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a school district policy to exempt district students
88 from the administration of certain assessment instruments and from
99 certain promotion and graduation requirements based on a student's
1010 satisfactory performance on those assessment instruments.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 28.021, Education Code, is amended by
1313 adding Subsection (c-1) to read as follows:
1414 (c-1) Subsection (c)(3) does not apply to an assessment
1515 instrument administered under Section 39.023(a), (b), or (l), if
1616 the school district in which the student is enrolled has exempted
1717 district students from the administration of the assessment
1818 instrument under a district policy adopted under Section 39.02303.
1919 SECTION 2. Section 28.025(b-4), Education Code, is amended
2020 to read as follows:
2121 (b-4) A school district may offer the curriculum described
2222 in Subsections (b-1)(1) through (4) in an applied manner. Courses
2323 delivered in an applied manner must cover the essential knowledge
2424 and skills, and the student shall be administered the applicable
2525 end-of-course assessment instrument as provided by Sections
2626 39.023(c) and 39.025, unless the student is enrolled in a district
2727 that has exempted district students from the administration of the
2828 applicable assessment instrument under a policy adopted under
2929 Section 39.02303.
3030 SECTION 3. Subchapter B, Chapter 39, Education Code, is
3131 amended by adding Section 39.02303 to read as follows:
3232 Sec. 39.02303. SCHOOL DISTRICT OPTION TO EXEMPT STUDENTS
3333 FROM ADMINISTRATION OF CERTAIN ASSESSMENT INSTRUMENTS. (a) The
3434 board of trustees of each school district may adopt a policy
3535 exempting students from the administration of any of the following
3636 assessment instruments:
3737 (1) the social studies assessment instrument
3838 administered in grade eight as provided by Section 39.023(a);
3939 (2) the United States history end-of-course
4040 assessment instrument as provided by Section 39.023(c);
4141 (3) the English II end-of-course assessment
4242 instrument as provided by Section 39.023(c);
4343 (4) any other assessment instrument administered
4444 under this subchapter that is not required by federal law; and
4545 (5) any federally required assessment instrument for
4646 which the commissioner of education obtains a waiver described by
4747 Subsection (d).
4848 (b) At the beginning of each school year, a school district
4949 or open-enrollment charter school shall notify the parent or
5050 guardian of each student enrolled in the district or school that the
5151 parent or guardian may request information regarding the district's
5252 policy adopted under Subsection (a).
5353 (c) Notwithstanding any other law, a student does not fail
5454 to perform satisfactorily on an assessment instrument administered
5555 under this subchapter if the student is not administered the
5656 assessment instrument because the school district policy adopted
5757 under Subsection (a) exempts district students from the
5858 administration of the assessment instrument.
5959 (d) The commissioner of education shall request from the
6060 United States Department of Education a waiver from the application
6161 of any conflicting federal law or regulation requiring the
6262 administration of assessment instruments to students in certain
6363 subject areas.
6464 SECTION 4. Section 39.025, Education Code, is amended by
6565 adding Subsection (a-6) to read as follows:
6666 (a-6) If a school district in which a student is enrolled
6767 has exempted district students, under a district policy adopted
6868 under Section 39.02303, from the administration of an end-of-course
6969 assessment instrument administered under Section 39.023(c):
7070 (1) the requirement under Subsection (a) for
7171 satisfactory performance on that end-of-course assessment
7272 instrument does not apply; and
7373 (2) the student may not be denied a high school diploma
7474 under this section because the student was not administered the
7575 applicable assessment instrument.
7676 SECTION 5. As soon as practicable after the effective date
7777 of this Act, the commissioner of education shall request from the
7878 United States Department of Education a waiver from the application
7979 of any conflicting federal law or regulation requiring the
8080 administration of assessment instruments to a student enrolled in a
8181 school district that has adopted a district policy under Section
8282 39.02303, Education Code, as added by this Act, exempting district
8383 students from the administration of assessment instruments in a
8484 subject area for which administration of assessment instruments is
8585 required under the Every Student Succeeds Act (20 U.S.C. Section
8686 7801).
8787 SECTION 6. This Act applies beginning with the 2021-2022
8888 school year.
8989 SECTION 7. This Act takes effect immediately if it receives
9090 a vote of two-thirds of all the members elected to each house, as
9191 provided by Section 39, Article III, Texas Constitution. If this
9292 Act does not receive the vote necessary for immediate effect, this
9393 Act takes effect September 1, 2021.
