85 AN ACT
96 relating to a feasibility study on the colocation of federal and
107 state motor vehicle inspection facilities at ports of entry.
118 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
129 SECTION 1. DEFINITIONS. In this Act:
1310 (1) "Department" means the Texas Department of
1411 Transportation.
1512 (2) "Institute" means the Texas A&M Transportation
1613 Institute.
1714 (3) "Port of entry" has the meaning assigned by
1815 Section 201.710, Transportation Code.
1916 SECTION 2. FEASIBILITY STUDY ON COLOCATED INSPECTION PORTS.
2017 (a) The institute, in consultation with the department and the
2118 Department of Public Safety, shall conduct a feasibility study on
2219 erecting and maintaining a colocated federal and state inspection
2320 facility at each port of entry in this state for the inspection of
2421 motor vehicles for compliance with federal and state commercial
2522 motor vehicle regulations. The study must include:
2623 (1) a summary of:
2724 (A) past efforts by the Department of Public
2825 Safety and the Federal Motor Carrier Safety Administration to
2926 maintain colocated federal and state inspection facilities at each
3027 port of entry;
3128 (B) any current efforts to colocate or separate
3229 federal and state inspection facilities at ports of entry in other
3330 states;
34- (C) current wait times at inspection facilities
35- at each port of entry;
36- (D) current priorities and expectations of the
31+ (C) current priorities and expectations of the
3732 department and the Department of Public Safety regarding motor
3833 vehicle inspections at ports of entry;
39- (E) the department's and Department of Public
34+ (D) the department's and Department of Public
4035 Safety's perspectives on the advantages and disadvantages of
4136 colocated federal and state inspection facilities; and
42- (F) the Federal Motor Carrier Safety
37+ (E) the Federal Motor Carrier Safety
4338 Administration's perspective on the advantages and disadvantages
4439 of colocated federal and state inspection facilities, as solicited
45- by the institute under Subsection (b) of this section;
40+ by the institute under Subsection (b) of this section; and
4641 (2) potential scenarios for the colocation of federal
4742 and state inspection facilities at each port of entry in this state
48- and an analysis of each scenario's advantages and disadvantages;
49- (3) an analysis of potential economic benefits of
50- colocating federal and state inspection facilities at each port of
51- entry; and
52- (4) an analysis of the potential effects of colocating
53- federal and state inspection facilities at each point of entry on
54- wait times at inspection facilities.

5544 (b) In conducting the study under this section, the
5645 institute shall solicit the Federal Motor Carrier Safety
5746 Administration's perspective on the advantages and disadvantages
5847 of colocated federal and state inspection facilities.
59- SECTION 3. REPORT. (a) Before the study under Section 2 of
60- this Act is completed, the institute shall contact the Federal
61- Motor Carrier Safety Administration to arrange receipt of the
62- report required by this subsection. Not later than December 1,
63- 2022, the institute shall report the results of the study conducted
64- under Section 2 of this Act and any recommendations to the Federal
65- Motor Carrier Safety Administration in the manner and format
66- requested by the Federal Motor Carrier Safety Administration.
67- (b) Not later than December 1, 2022, the institute shall
68- submit to the members of the legislature a report on the results of
69- the study conducted under Section 2 of this Act and any
70- recommendations for legislative or other action.
48+ SECTION 3. REPORT. Before the study under Section 2 of this
49+ Act is completed, the institute shall contact the Federal Motor
50+ Carrier Safety Administration to arrange receipt of the report
51+ required by this section. Not later than December 1, 2022, the
52+ institute shall report the results of the study conducted under
53+ Section 2 of this Act and any recommendations to the Federal Motor
54+ Carrier Safety Administration in the manner and format requested by
55+ the Federal Motor Carrier Safety Administration.
7156 SECTION 4. EXPIRATION DATE. This Act expires January 1,
7257 2023.
73- SECTION 5. IMPLEMENTATION. The Texas A&M Transportation
74- Institute is required to implement this Act only if the legislature
75- appropriates money specifically for that purpose. If the
76- legislature does not appropriate money specifically for that
77- purpose, the Texas A&M Transportation Institute may, but is not
78- required to, implement this Act using other appropriations
79- available for the purpose.
80- SECTION 6. EFFECTIVE DATE. This Act takes effect September
