---|
7 | 7 | | relating to a study of the desirability, feasibility, and effects |
---|
8 | 8 | | of limiting the appraised value of real property for ad valorem tax |
---|
9 | 9 | | purposes to the value when the owner acquired the property and |
---|
10 | 10 | | determining that value on the basis of the purchase price of the |
---|
11 | 11 | | property, if applicable. |
---|
12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
13 | 13 | | SECTION 1. DEFINITION. In this section, "commission" means |
---|
14 | 14 | | the Real Property Appraisal Study Commission. |
---|
15 | 15 | | SECTION 2. COMPOSITION OF COMMISSION. The commission is |
---|
16 | 16 | | composed of nine members as follows: |
---|
17 | 17 | | (1) the comptroller of public accounts; |
---|
18 | 18 | | (2) two chief appraisers appointed by the comptroller |
---|
19 | 19 | | of public accounts, one of whom is employed by an appraisal district |
---|
20 | 20 | | established in an urban county and one of whom is employed by an |
---|
21 | 21 | | appraisal district established in a rural county; |
---|
22 | 22 | | (3) two members of the senate appointed by the |
---|
23 | 23 | | lieutenant governor; |
---|
24 | 24 | | (4) two members of the house of representatives |
---|
25 | 25 | | appointed by the speaker of the house of representatives; and |
---|
26 | 26 | | (5) two public members appointed by the governor. |
---|
27 | 27 | | SECTION 3. PRESIDING OFFICER. The comptroller of public |
---|
28 | 28 | | accounts is the presiding officer of the commission. |
---|
29 | 29 | | SECTION 4. MEETINGS. The commission shall meet at the call |
---|
30 | 30 | | of the presiding officer of the commission. |
---|
31 | 31 | | SECTION 5. STAFF. The staff of the office of the |
---|
32 | 32 | | comptroller of public accounts shall serve as the staff of the |
---|
33 | 33 | | commission. |
---|
34 | 34 | | SECTION 6. COMPENSATION; REIMBURSEMENT FOR EXPENSES. A |
---|
35 | 35 | | commission member is not entitled to receive compensation for |
---|
36 | 36 | | service on the commission but is entitled to reimbursement for |
---|
37 | 37 | | actual and necessary expenses, including travel expenses, incurred |
---|
38 | 38 | | by the member in performing commission duties. |
---|
39 | 39 | | SECTION 7. STUDY. The commission shall conduct a study of |
---|
40 | 40 | | the desirability, feasibility, and effects of limiting the |
---|
41 | 41 | | appraised value of real property for ad valorem tax purposes to the |
---|
42 | 42 | | value when the owner acquired the property and determining that |
---|
43 | 43 | | value on the basis of the purchase price of the property, if |
---|
44 | 44 | | applicable, including: |
---|
45 | 45 | | (1) the fairness of doing so; |
---|
46 | 46 | | (2) the effects of doing so on the overall tax burden |
---|
47 | 47 | | and the distribution of the tax burden; |
---|
48 | 48 | | (3) the effects of doing so on the real estate market; |
---|
49 | 49 | | and |
---|
50 | 50 | | (4) the statutory, constitutional, and administrative |
---|
51 | 51 | | changes that would be necessary to do so. |
---|
52 | 52 | | SECTION 8. REPORT. Not later than December 1, 2022, the |
---|
53 | 53 | | commission shall issue a report of the results of the study, |
---|
54 | 54 | | including any legislative recommendations, to the governor, |
---|
55 | 55 | | lieutenant governor, and speaker of the house of representatives. |
---|
56 | 56 | | SECTION 9. ABOLITION AND EXPIRATION. The commission is |
---|
57 | 57 | | abolished and this Act expires September 1, 2023. |
---|
58 | 58 | | SECTION 10. EFFECTIVE DATE. This Act takes effect |
---|
59 | 59 | | immediately if it receives a vote of two-thirds of all the members |
---|
60 | 60 | | elected to each house, as provided by Section 39, Article III, Texas |
---|
61 | 61 | | Constitution. If this Act does not receive the vote necessary for |
---|
62 | 62 | | immediate effect, this Act takes effect September 1, 2021. |
