55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a study of the desirability, feasibility, and effects
88 of limiting the appraised value of real property for ad valorem tax
99 purposes to the value when the owner acquired the property and
1010 determining that value on the basis of the purchase price of the
1111 property, if applicable.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. DEFINITION. In this section, "commission" means
1414 the Real Property Appraisal Study Commission.
1515 SECTION 2. COMPOSITION OF COMMISSION. The commission is
1616 composed of nine members as follows:
1717 (1) the comptroller of public accounts;
1818 (2) two chief appraisers appointed by the comptroller
1919 of public accounts, one of whom is employed by an appraisal district
2020 established in an urban county and one of whom is employed by an
2121 appraisal district established in a rural county;
2222 (3) two members of the senate appointed by the
2323 lieutenant governor;
2424 (4) two members of the house of representatives
2525 appointed by the speaker of the house of representatives; and
2626 (5) two public members appointed by the governor.
2727 SECTION 3. PRESIDING OFFICER. The comptroller of public
2828 accounts is the presiding officer of the commission.
2929 SECTION 4. MEETINGS. The commission shall meet at the call
3030 of the presiding officer of the commission.
3131 SECTION 5. STAFF. The staff of the office of the
3232 comptroller of public accounts shall serve as the staff of the
3333 commission.
3434 SECTION 6. COMPENSATION; REIMBURSEMENT FOR EXPENSES. A
3535 commission member is not entitled to receive compensation for
3636 service on the commission but is entitled to reimbursement for
3737 actual and necessary expenses, including travel expenses, incurred
3838 by the member in performing commission duties.
3939 SECTION 7. STUDY. The commission shall conduct a study of
4040 the desirability, feasibility, and effects of limiting the
4141 appraised value of real property for ad valorem tax purposes to the
4242 value when the owner acquired the property and determining that
4343 value on the basis of the purchase price of the property, if
4444 applicable, including:
4545 (1) the fairness of doing so;
4646 (2) the effects of doing so on the overall tax burden
4747 and the distribution of the tax burden;
4848 (3) the effects of doing so on the real estate market;
4949 and
5050 (4) the statutory, constitutional, and administrative
5151 changes that would be necessary to do so.
5252 SECTION 8. REPORT. Not later than December 1, 2022, the
5353 commission shall issue a report of the results of the study,
5454 including any legislative recommendations, to the governor,
5555 lieutenant governor, and speaker of the house of representatives.
5656 SECTION 9. ABOLITION AND EXPIRATION. The commission is
5757 abolished and this Act expires September 1, 2023.
5858 SECTION 10. EFFECTIVE DATE. This Act takes effect
5959 immediately if it receives a vote of two-thirds of all the members
6060 elected to each house, as provided by Section 39, Article III, Texas
6161 Constitution. If this Act does not receive the vote necessary for
6262 immediate effect, this Act takes effect September 1, 2021.
