44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to prohibiting certain limitations on the operation of
77 certain organizations that benefit veterans during a declared state
88 of disaster.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 418.012, Government Code, is amended to
1111 read as follows:
1212 Sec. 418.012. EXECUTIVE ORDERS. (a) Under this chapter,
1313 the governor may issue executive orders, proclamations, and
1414 regulations and amend or rescind them. Executive orders,
1515 proclamations, and regulations have the force and effect of law.
1616 (b) An executive order, proclamation, or regulation issued
1717 by the governor under this chapter that restricts the operation of
1818 or the hours of operation for a business that sells alcoholic
1919 beverages may not include an organization exempt from federal
2020 taxation under Section 501(a), Internal Revenue Code of 1986, as an
2121 organization described by Section 501(c)(19) of that code, that
2222 benefits veterans of the United States armed forces.
2323 SECTION 2. Section 418.012, Government Code, as amended by
2424 this Act, applies only to a declaration of a state of disaster
2525 issued or renewed on or after the effective date of this Act. A
2626 declaration issued before the effective date of this Act is
2727 governed by the law in effect immediately before the effective date
2828 of this Act, and that law is continued in effect for that purpose.
2929 SECTION 3. This Act takes effect immediately if it receives
3030 a vote of two-thirds of all the members elected to each house, as
3131 provided by Section 39, Article III, Texas Constitution. If this
3232 Act does not receive the vote necessary for immediate effect, this
3333 Act takes effect September 1, 2021.
