55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the winter weather emergency preparedness of facilities
88 for providing electric service.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 35, Utilities Code, is
1111 amended by adding Section 35.0025 to read as follows:
1212 Sec. 35.0025. WINTER WEATHER EMERGENCY PREPAREDNESS. (a)
1313 The commission by rule shall establish best practices and
1414 procedures for providers of generation in the ERCOT power region
1515 for:
1616 (1) winterization, including supplies, equipment,
1717 personnel, and preventative action checklists for preparations for
1818 extreme weather events;
1919 (2) plant design for new plants and modifications to
2020 existing plants to ensure the plants can operate at the lowest
2121 recorded ambient temperature for the nearest municipality for which
2222 historical data is available;
2323 (3) maintenance and inspections, especially of freeze
2424 protection elements;
2525 (4) heat tracing;
2626 (5) thermal insulation;
2727 (6) the erection of adequate windbreaks and
2828 enclosures;
2929 (7) annual winter-specific and plant-specific
3030 operator awareness and maintenance training;
3131 (8) prioritizing winter preparation each fall;
3232 (9) establishing personnel accountability and audit
3333 procedures; and
3434 (10) updating facility procedures at least annually as
3535 needed.
3636 (b) The commission by rule shall require each provider of
3737 generation in the ERCOT power region to:
3838 (1) prepare, submit to the commission, and update as
3939 necessary a plan for:
4040 (A) using the best practices and procedures to
4141 provide adequate electric generation service during a winter
4242 weather emergency;
4343 (B) conducting regular preventative maintenance
4444 for freeze protection elements;
4545 (C) inspecting freeze protection elements before
4646 and during the winter;
4747 (D) testing and evaluating freeze protection
4848 elements after winter to identify potential improvements, required
4949 maintenance, and any necessary component replacement; and
5050 (E) making any needed repairs or improvements
5151 before the next winter; and
5252 (2) implement the plan submitted under Subdivision
5353 (1).
5454 (c) The commission shall regularly inspect facilities of
5555 providers of generation for compliance with rules adopted under
5656 this section.
5757 SECTION 2. Subchapter D, Chapter 38, Utilities Code, is
5858 amended by adding Section 38.074 to read as follows:
5959 Sec. 38.074. WINTER WEATHER EMERGENCY PREPAREDNESS. (a)
6060 The commission by rule shall establish best practices and
6161 procedures for electric cooperatives, municipally owned utilities,
6262 and transmission and distribution utilities providing transmission
6363 or distribution service in the ERCOT power region for:
6464 (1) winterization, including supplies, equipment,
6565 personnel, and preventative action checklists for preparations for
6666 extreme weather events;
6767 (2) maintenance and inspections, especially of freeze
6868 protection elements;
6969 (3) heat tracing;
7070 (4) thermal insulation;
7171 (5) the erection of adequate windbreaks and
7272 enclosures;
7373 (6) annual winter-specific operator awareness and
7474 maintenance training;
7575 (7) prioritizing winter preparation each fall;
7676 (8) establishing personnel accountability and audit
7777 procedures; and
7878 (9) updating facility procedures at least annually as
7979 needed.
8080 (b) The commission by rule shall require each electric
8181 cooperative, municipally owned utility, and transmission and
8282 distribution utility providing transmission or distribution
8383 service in the ERCOT power region to:
8484 (1) prepare, submit to the commission, and update as
8585 necessary a plan for:
8686 (A) using the best practices and procedures to
8787 maintain service quality and reliability during a winter weather
8888 emergency;
8989 (B) conducting regular preventative maintenance
9090 for freeze protection elements;
9191 (C) inspecting freeze protection elements before
9292 and during the winter;
9393 (D) testing and evaluating freeze protection
9494 elements after winter to identify potential improvements, required
9595 maintenance, and any necessary component replacement; and
9696 (E) making any needed repairs or improvements
9797 before the next winter; and
9898 (2) implement the plan submitted under Subdivision
9999 (1).
100100 (c) The commission shall regularly inspect facilities of
101101 electric cooperatives, municipally owned utilities, and
102102 transmission and distribution utilities providing transmission or
103103 distribution service in the ERCOT power region for compliance with
104104 rules adopted under this section.
105105 SECTION 3. This Act takes effect September 1, 2021.
