| 8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 9 | 9 | SECTION 1. Section 252.043(d-1), Local Government Code, is | |
| 10 | 10 | amended to read as follows: | |
| 11 | 11 | (d-1) A contract for construction of a project described by | |
| 12 | 12 | Subsection (d) that requires an expenditure of $1.5 million$5 | |
| 13 | 13 | million or less may be awarded using the competitive sealed | |
| 14 | 14 | proposal procedure prescribed by Subchapter D, Chapter 2269, | |
| 15 | 15 | Government Code. | |
| 16 | 16 | SECTION 2. The change in law made by this Act applies only | |
| 17 | 17 | to a contract for the procurement of goods and services for which | |
| 18 | 18 | the solicitation of bids or proposals, request for proposals, or | |
| 19 | 19 | similar required notification as to the goods or services is | |
| 20 | 20 | published on or after September 1, 2021. A contract for which the | |
| 21 | 21 | required notification is published before September 1, 2021, is | |
| 22 | 22 | governed by the law in effect on the date the notification was | |
| 23 | 23 | published, and the former law is continued in effect for that | |
| 24 | 24 | purpose. | |
| 25 | 25 | SECTION 3. This Act takes effect September 1, 2021. |
