77 relating to the emergency coordination of advanced communications
88 service.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle C, Title 2, Utilities Code, is amended
1111 by adding Chapter 67 to read as follows:
1212 CHAPTER 67. EMERGENCY COORDINATION OF ADVANCED COMMUNICATIONS
1313 SERVICE
1414 Sec. 67.0101. DEFINITION. In this chapter, "advanced
1515 communications service" means:
1616 (1) interconnected Voice over Internet Protocol
1717 service, such as home telephone service provided by an Internet
1818 service provider;
1919 (2) non-interconnected Voice over Internet Protocol
2020 service, such as using a computer to engage in voice communication
2121 over the Internet;
2222 (3) electronic messaging service, such as text
2323 messaging, instant messaging, or e-mail; or
2424 (4) interoperable videoconferencing service.
2525 Sec. 67.0102. POWER TO REGULATE AND SUPERVISE. (a) The
2626 commission has authority to regulate and supervise a provider of
2727 advanced communications service for the purposes of this chapter.
2828 (b) This chapter does not grant the commission authority to
2929 regulate and supervise a provider of advanced communications
3030 service for a purpose other than the purposes of this chapter.
3131 Sec. 67.0103. EMERGENCY COORDINATION. (a) The commission
3232 by rule shall provide for coordination among providers of advanced
3333 communications service during times of emergency, including
3434 requiring providers of wireless advanced communications service to
3535 have in place reasonable roaming and peering agreements for times
3636 of emergency that can be employed without additional negotiation.
3737 (b) The commission shall distribute a set of recommended
3838 best practices on how providers of advanced communications service
3939 and providers of electricity service should coordinate in order to
4040 ensure that advanced communications service remains operational
4141 during times of emergency and preplanned power downs.
4242 (c) The commission shall:
4343 (1) establish a process by which providers of advanced
4444 communications service and providers of electricity service share
4545 information regarding prioritizing infrastructure that is used in
4646 the provision of advanced communications service for restoring
4747 power to best restore critical parts of advanced communications
4848 service networks necessary for emergency response and restoration
4949 efforts, in a manner that promotes the most efficient and effective
5050 use of resources during times of emergency and preplanned power
5151 outages;
5252 (2) ensure that providers of advanced communications
5353 service take reasonable and technically feasible measures to
5454 integrate backup power, including generators and batteries, into
5555 advanced communications service networks to continue the provision
5656 of advanced communications service during and following times of
5757 emergency and during preplanned power outages, with particular
5858 focus on consumers' ability to send and receive emergency
5959 communications; and
6060 (3) take all necessary, reasonable measures to ensure
6161 appropriate coordination, including at incident command centers
6262 established during times of emergency, between providers of
6363 electricity service and providers of advanced communications
6464 service and, where appropriate, state and local representatives to
6565 ensure the providers:
6666 (A) are aware of where infrastructure used in the
6767 provision of advanced communications service is located to avoid
6868 inadvertently damaging such infrastructure and delaying
6969 restoration of advanced communications service during and
7070 following times of emergency and preplanned power outages;
7171 (B) communicate with each other on a regular and
7272 ongoing basis regarding the progress of network restoration during
7373 and following times of emergency and preplanned power outages; and
7474 (C) are aware of their respective restoration
7575 plans, priorities, and critical sites in advance of any emergency,
7676 as well as during and following times of emergency and preplanned
7777 power outages.
7878 SECTION 2. This Act takes effect September 1, 2021.
