8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Article 2.13, Code of Criminal Procedure is | |
10 | 10 | amended by adding Subsection (g) to read as follows: | |
11 | 11 | (g) If an officer has lawfully arrested or detained a | |
12 | 12 | person, or has good cause to believe that a person is a witness to a | |
13 | 13 | criminal offense, the officer may request that the person provide | |
14 | 14 | the officer with the person's name, residence address, and date of | |
15 | 15 | birth, and the person may not refuse to provide the requested | |
16 | 16 | information to the officer. A person who refuses to give to an | |
17 | 17 | officer information requested under this subsection commits an | |
18 | 18 | offense under Section 38.02, Penal Code. Each law enforcement | |
19 | 19 | agency shall adopt a written policy regarding the collection of | |
20 | 20 | information under this subsection. | |
21 | 21 | SECTION 2. This Act takes effect September 1, 2021. |
