44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the duties and oversight of the Department of Public
77 Safety's office of inspector general regarding the use of cyber
88 technology and activity.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 411.251, Government Code, is amended by
1111 amending Subsection (b) and adding Subsection (c) to read as
1212 follows:
1313 (b) The office of inspector general is responsible for:
1414 (1) acting to prevent and detect serious breaches of
1515 departmental policy, fraud, and abuse of office, including any acts
1616 of criminal conduct within the department; [and]
1717 (2) independently and objectively reviewing,
1818 investigating, delegating, and overseeing the investigation of:
1919 (A) conduct described in Subdivision (1);
2020 (B) criminal activity occurring in all divisions
2121 of the department;
2222 (C) allegations of wrongdoing by department
2323 employees;
2424 (D) crimes committed on department property; and
2525 (E) serious breaches of department policy[.];
2626 and
2727 (3) independently and objectively reviewing,
2828 investigating, and overseeing the Department's cyber activity and
2929 use of cyber networks, operations, systems, and tools.
3030 (c) For purposes of this subchapter, "cyber tools" include,
3131 but are not limited to cyber networks, operations, systems, and any
3232 hardware or software used to collect suspicious activity reports or
3333 used by the Department for cyber activity in carrying out its
3434 official duties.
3535 SECTION 2. Section 411.253, Government Code, is amended to
3636 read as follows:
3737 The office of inspector general may only initiate an
3838 investigation based on:
3939 (1) authorization from the commission;
4040 (2) approval of the inspector general or deputy
4141 inspector general;
4242 (3) approval of the director, a deputy director, an
4343 assistant director of the Texas Rangers, or an assistant director
4444 of the criminal investigations division for criminal
4545 investigations; [or]
4646 (4) commission rules or approved commission policies;
4747 or
4848 (5) authorization from the commission for an
4949 investigation regarding the Department's use of cyber tools.
5050 SECTION 3. Subchapter B-1, Chapter 411, Government Code, is
5151 amended by adding Section 411.2531 to read as follows:
5252 Section 411.2531. OVERSIGHT OF CYBER TOOLS. The office of
5353 inspector general shall:
5454 (a) continually monitor the Department's use of cyber tools
5555 solely under the direction of the commission; and
5656 (b) employ personnel with adequate education, training, and
5757 experience in cyber activity, the use of cyber tools, and in privacy
5858 and constitutional protections when using cyber tools.
5959 SECTION 3. This Act takes effect immediately if it receives
6060 a vote of two-thirds of all the members elected to each house, as
6161 provided by Section 39, Article III, Texas Constitution. If this
6262 Act does not receive the vote necessary for immediate effect, this
6363 Act takes effect September 1, 2021.
