10- prevention and certain state laws applicable to handgun license
11- holders.
7+ relating to the provision of information regarding firearm violence
8+ and suicide prevention.
129 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1310 SECTION 1. Section 411.185(d), Government Code, is amended
1411 to read as follows:
1512 (d) Not later than the 60th day before the expiration date
16- of the license, the department shall mail or e-mail to each license
17- holder a written notice of the expiration of the license, a renewal
13+ of the license, the department shall mail to each license holder a
14+ written notice of the expiration of the license, a renewal
1815 application form, [and] the informational form described by
19- Subsection (c), and the brochure described by Section 411.02096.
20- SECTION 2. Subchapter A, Chapter 411, Government Code, is
21- amended by adding Section 411.02096 to read as follows:
22- Sec. 411.02096. SUICIDE PREVENTION INFORMATION. (a) The
23- department shall post on the department's Internet website a
24- printable brochure, developed in cooperation with the Health and
25- Human Services Commission, that includes the following suicide
26- prevention information:
16+ Subsection (c), and the brochure described by Section 411.222(a).
17+ SECTION 2. Section 411.188(b), Government Code, is amended
18+ to read as follows:
19+ (b) Only qualified handgun instructors may administer the
20+ range instruction part of the handgun proficiency course. A
21+ qualified handgun instructor or approved online course provider may
22+ administer the classroom instruction part of the handgun
23+ proficiency course. The classroom instruction part of the course
24+ must include not less than four hours and not more than six hours of
25+ instruction on:
26+ (1) the laws that relate to weapons and to the use of
27+ deadly force;
28+ (2) handgun use and safety, including use of restraint
29+ holsters and methods to ensure the secure carrying of openly
30+ carried handguns;
31+ (3) nonviolent dispute resolution; [and]
32+ (4) proper storage practices for handguns with an
33+ emphasis on storage practices that eliminate the possibility of
34+ accidental injury to a child; and
35+ (5) the information covered in the brochure described
36+ by Section 411.222(a).
37+ SECTION 3. Chapter 411, Government Code, is amended by
38+ adding Subchapter H-1 to read as follows:
39+ SUBCHAPTER H-1. REQUIREMENTS FOR CERTAIN FIREARM TRANSFERS
40+ Sec. 411.221. DEFINITION. In this subchapter, "licensed
41+ firearms dealer" means a person who is licensed as a firearms dealer
42+ under 18 U.S.C. Section 923.
43+ Sec. 411.222. FIREARM VIOLENCE AND SUICIDE PREVENTION
44+ INFORMATION. (a) The department shall post on the department's
45+ Internet website a printable brochure, developed in cooperation
46+ with the Health and Human Services Commission, that includes the
47+ following firearm violence and suicide prevention information:
2748 (1) information regarding:
28- (A) the warning signs that a person is at risk of
49+ (A) statistics regarding victims of firearm
50+ violence;
51+ (B) the warning signs that a person is at risk of
2952 suicide;
30- (B) suicide prevention; and
31- (C) state agencies that provide mental health and
53+ (C) suicide prevention; and
54+ (D) state agencies that provide mental health and
3255 suicide prevention services; and
3356 (2) the phone number for the National Suicide
3457 Prevention Lifeline.
3558 (b) Not later than October 1 of each year, the department
3659 shall update the brochure required by Subsection (a).
37- (c) The department shall provide the brochure required by
38- Subsection (a) by mail or e-mail to each new applicant for a license
39- to carry a handgun issued under Subchapter H.
40- SECTION 3. This Act takes effect September 1, 2021.
60+ Sec. 411.223. REQUIREMENTS FOR CERTAIN FIREARM TRANSFERS.
61+ (a) Except as provided by Subsection (b), a licensed firearms
62+ dealer may not sell or transfer a firearm to another person unless,
63+ at the time of the sale or transfer, the dealer provides a copy of
64+ the brochure described by Section 411.222(a) to the person to whom
65+ the firearm is being sold or transferred. The dealer may provide
66+ the brochure to the transferee in hard copy or electronic form.
67+ (b) Subsection (a) does not apply to sale or transfer of a
68+ firearm if the transferee presents a valid license to carry a
69+ handgun issued under Subchapter H.
70+ SECTION 4. This Act takes effect September 1, 2021.
