55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the inclusion of certain chronically absent students as
88 students at risk of dropping out of school and the collection and
99 reporting of data regarding those students.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 29.081(d), Education Code, as amended by
1212 Chapters 403 (S.B. 1746), 597 (S.B. 668), and 1060 (H.B. 1051), Acts
1313 of the 86th Legislature, Regular Session, 2019, is reenacted and
1414 amended to read as follows:
1515 (d) For purposes of this section, "student at risk of
1616 dropping out of school" includes each student who:
1717 (1) is under 26 years of age and who:
1818 (A) was not advanced from one grade level to the
1919 next for one or more school years;
2020 (B) if the student is in grade 7, 8, 9, 10, 11, or
2121 12, did not maintain an average equivalent to 70 on a scale of 100 in
2222 two or more subjects in the foundation curriculum during a semester
2323 in the preceding or current school year or is not maintaining such
2424 an average in two or more subjects in the foundation curriculum in
2525 the current semester;
2626 (C) did not perform satisfactorily on an
2727 assessment instrument administered to the student under Subchapter
2828 B, Chapter 39, and who has not in the previous or current school
2929 year subsequently performed on that instrument or another
3030 appropriate instrument at a level equal to at least 110 percent of
3131 the level of satisfactory performance on that instrument;
3232 (D) if the student is in prekindergarten,
3333 kindergarten, or grade 1, 2, or 3, did not perform satisfactorily on
3434 a readiness test or assessment instrument administered during the
3535 current school year;
3636 (E) is pregnant or is a parent;
3737 (F) has been placed in an alternative education
3838 program in accordance with Section 37.006 during the preceding or
3939 current school year;
4040 (G) has been expelled in accordance with Section
4141 37.007 during the preceding or current school year;
4242 (H) is currently on parole, probation, deferred
4343 prosecution, or other conditional release;
4444 (I) was previously reported through the Public
4545 Education Information Management System (PEIMS) to have dropped out
4646 of school;
4747 (J) is a student of limited English proficiency,
4848 as defined by Section 29.052;
4949 (K) is in the custody or care of the Department of
5050 Family and Protective Services or has, during the current school
5151 year, been referred to the department by a school official, officer
5252 of the juvenile court, or law enforcement official;
5353 (L) is homeless;
5454 (M) resided in the preceding school year or
5555 resides in the current school year in a residential placement
5656 facility in the district, including a detention facility, substance
5757 abuse treatment facility, emergency shelter, psychiatric hospital,
5858 halfway house, cottage home operation, specialized child-care
5959 home, or general residential operation; [or]
6060 (N) [(14)] has been incarcerated or has a parent
6161 or guardian who has been incarcerated, within the lifetime of the
6262 student, in a penal institution as defined by Section 1.07, Penal
6363 Code; or
6464 (O) if the student is in kindergarten through
6565 grade six, is a chronically absent student, as defined by Section
6666 48.009; or
6767 (2) regardless of the student's age, participates in
6868 an adult education program provided under a high school diploma and
6969 industry certification charter school program under Section
7070 29.259.
7171 SECTION 2. Section 48.009, Education Code, is amended by
7272 amending Subsections (a) and (b) and adding Subsection (c-1) to
7373 read as follows:
7474 (a) In this section:
7575 (1) "Chronically absent student" means a student who
7676 is absent from school for more than 10 percent of the days within:
7777 (A) a school year; or
7878 (B) a six-week grade reporting period.
7979 (2) "Full-time [,"full-time] equivalent school
8080 counselor" means 40 hours of counseling services a week.
8181 (b) The commissioner by rule shall require each school
8282 district and open-enrollment charter school to report through the
8383 Public Education Information Management System information
8484 regarding:
8585 (1) the number of students enrolled in the district or
8686 school who are identified as having dyslexia;
8787 (2) the availability of school counselors, including
8888 the number of full-time equivalent school counselors, at each
8989 campus;
9090 (3) the availability of expanded learning
9191 opportunities as described by Section 33.252 at each campus;
9292 (4) the total number of students, other than students
9393 described by Subdivision (5), enrolled in the district or school
9494 with whom the district or school, as applicable, used intervention
9595 strategies, as that term is defined by Section 26.004, at any time
9696 during the year for which the report is made; [and]
9797 (5) the total number of students enrolled in the
9898 district or school to whom the district or school provided aids,
9999 accommodations, or services under Section 504, Rehabilitation Act
100100 of 1973 (29 U.S.C. Section 794), at any time during the year for
101101 which the report is made; and
102102 (6) the total number of chronically absent students
103103 enrolled in kindergarten through grade six at a campus in the
104104 district or school disaggregated by students' race, ethnicity, and
105105 status as:
106106 (A) students enrolled in a special education
107107 program;
108108 (B) students identified as having dyslexia;
109109 (C) educationally disadvantaged students; and
110110 (D) students of limited English proficiency as
111111 defined by Section 29.052.
112112 (c-1) The agency shall annually aggregate and make publicly
113113 available the data on student chronic absenteeism collected under
114114 Subsection (b)(6). The data must:
115115 (1) be shown at the campus and district aggregate
116116 levels; and
117117 (2) include the percentage of chronically absent
118118 students enrolled in kindergarten through grade six in each
119119 demographic category listed under Subsection (b)(6).
120120 SECTION 3. To the extent of any conflict, this Act prevails
121121 over another Act of the 87th Legislature, Regular Session, 2021,
122122 relating to nonsubstantive additions to and corrections in enacted
123123 codes.
124124 SECTION 4. This Act takes effect September 1, 2021.
