7 | 7 | | relating to reporting requirements by the Texas Education Agency |

8 | 8 | | and certain school districts and open-enrollment charter schools |

9 | 9 | | regarding student attendance during a declared disaster. |
---|
10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Subchapter C, Chapter 25, Education Code, is |
---|
12 | 12 | | amended by adding Section 25.0875 to read as follows: |
---|
13 | 13 | | Sec. 25.0875. REQUIRED REPORTING OF ATTENDANCE DURING |
---|
14 | 14 | | DECLARED DISASTER. (a) In this section, "declared disaster" |
---|
15 | 15 | | means: |
---|
16 | 16 | | (1) a disaster declared by the president of the United |
---|
17 | 17 | | States; |
---|
18 | 18 | | (2) a state of disaster declared by the governor under |
---|
19 | 19 | | Section 418.014, Government Code; or |
---|
20 | 20 | | (3) a local state of disaster declared by the |
---|
21 | 21 | | presiding officer of the governing body of a political subdivision |
---|
22 | 22 | | under Section 418.108, Government Code. |
---|
23 | 23 | | (b) If the operations or in-person student attendance of a |
---|
24 | 24 | | school district or open-enrollment charter school are |
---|
25 | 25 | | substantially disrupted as a result of a declared disaster, the |
---|
26 | 26 | | district school shall submit a report to the agency in accordance |
---|
27 | 27 | | with Subsections (c) and (d). |
---|
28 | 28 | | (c) The report must include the total number, disaggregated |
---|
29 | 29 | | by student grade level, gender, race, being enrolled in a special |
---|
30 | 30 | | education program, being enrolled in a gifted and talented program, |
---|
31 | 31 | | being at risk of dropping out of school, being in foster care, |
---|
32 | 32 | | experiencing homelessness, being a dependent of military |
---|
33 | 33 | | personnel, having limited English proficiency, or being a migratory |
---|
34 | 34 | | child, of: |
---|
35 | 35 | | (1) students attending in-person; |
---|
36 | 36 | | (2) students attending remotely; and |
---|
37 | 37 | | (3) students experiencing chronic absenteeism. |
---|
38 | 38 | | (d) If the declared disaster lasts: |
---|
39 | 39 | | (1) for a period of less than 90 days, each affected |
---|
40 | 40 | | school district or open-enrollment charter school shall submit a |
---|
41 | 41 | | report to the agency not later than the 30th day following the |
---|
42 | 42 | | termination or expiration of the declared disaster; or |
---|
43 | 43 | | (2) for a period of more than 90 days, each affected |
---|
44 | 44 | | school district or open-enrollment charter school shall submit a |
---|
45 | 45 | | report to the agency every 90 days for the duration of the declared |
---|
46 | 46 | | disaster. |
---|
47 | 47 | | (e) The agency shall: |
---|
48 | 48 | | (1) aggregate the data received from each school |
---|
49 | 49 | | district and open-enrollment charter school under this section; and |
---|
50 | 50 | | (2) submit a report to the legislature not later than |
---|
51 | 51 | | 30 days after each required reporting period under Subsection (d). |
---|
52 | 52 | | SECTION 2. This Act applies beginning with the 2021-2022 |
---|
53 | 53 | | school year. |
---|
54 | 54 | | SECTION 3. This Act takes effect immediately if it receives |
---|
55 | 55 | | a vote of two-thirds of all the members elected to each house, as |
---|
56 | 56 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
57 | 57 | | Act does not receive the vote necessary for immediate effect, this |
---|
58 | 58 | | Act takes effect September 1, 2021. |
