66 AN ACT
77 relating to reporting requirements by the Texas Education Agency
88 and certain school districts and open-enrollment charter schools
99 regarding student attendance during a declared disaster.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter C, Chapter 25, Education Code, is
1212 amended by adding Section 25.0875 to read as follows:
1313 Sec. 25.0875. REQUIRED REPORTING OF ATTENDANCE DURING
1414 DECLARED DISASTER. (a) In this section, "declared disaster"
1515 means:
1616 (1) a disaster declared by the president of the United
1717 States;
1818 (2) a state of disaster declared by the governor under
1919 Section 418.014, Government Code; or
2020 (3) a local state of disaster declared by the
2121 presiding officer of the governing body of a political subdivision
2222 under Section 418.108, Government Code.
2323 (b) If the operations or in-person student attendance of a
2424 school district or open-enrollment charter school are
2525 substantially disrupted as a result of a declared disaster, the
2626 district school shall submit a report to the agency in accordance
2727 with Subsections (c) and (d).
2828 (c) The report must include the total number, disaggregated
2929 by student grade level, gender, race, being enrolled in a special
3030 education program, being enrolled in a gifted and talented program,
3131 being at risk of dropping out of school, being in foster care,
3232 experiencing homelessness, being a dependent of military
3333 personnel, having limited English proficiency, or being a migratory
3434 child, of:
3535 (1) students attending in-person;
3636 (2) students attending remotely; and
3737 (3) students experiencing chronic absenteeism.
3838 (d) If the declared disaster lasts:
3939 (1) for a period of less than 90 days, each affected
4040 school district or open-enrollment charter school shall submit a
4141 report to the agency not later than the 30th day following the
4242 termination or expiration of the declared disaster; or
4343 (2) for a period of more than 90 days, each affected
4444 school district or open-enrollment charter school shall submit a
4545 report to the agency every 90 days for the duration of the declared
4646 disaster.
4747 (e) The agency shall:
4848 (1) aggregate the data received from each school
4949 district and open-enrollment charter school under this section; and
5050 (2) submit a report to the legislature not later than
5151 30 days after each required reporting period under Subsection (d).
5252 SECTION 2. This Act applies beginning with the 2021-2022
5353 school year.
5454 SECTION 3. This Act takes effect immediately if it receives
5555 a vote of two-thirds of all the members elected to each house, as
5656 provided by Section 39, Article III, Texas Constitution. If this
5757 Act does not receive the vote necessary for immediate effect, this
5858 Act takes effect September 1, 2021.
