66 AN ACT
77 relating to establishing an assistance program to provide certain
88 health care services to certain medically fragile children.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle C, Title 2, Human Resources Code, is
1111 amended by adding Chapter 37 to read as follows:
1212 CHAPTER 37. MEDICALLY FRAGILE CHILDREN ASSISTANCE PROGRAM
1313 Sec. 37.001. DEFINITIONS. In this chapter:
1414 (1) "Child health plan program" means the child health
1515 plan program established under Chapters 62 and 63, Health and
1616 Safety Code.
1717 (2) "Medicaid" means the medical assistance program
1818 established under Chapter 32.
1919 (3) "Medically fragile child" means a person younger
2020 than 21 years of age who is:
2121 (A) chronically ill or disabled and requires
2222 indefinite skilled nursing care to maintain the person's existence
2323 in the person's home;
2424 (B) temporarily ill or disabled because of
2525 premature birth, accident, or trauma and has experienced a
2626 temporary lifestyle change requiring skilled nursing care;
2727 (C) suffering from uncontrollable seizures or
2828 other chronic illness; or
2929 (D) chronically dependent on medical devices to
3030 perform vital bodily functions.
3131 (4) "Program" means the program to provide health care
3232 services to medically fragile children established under Section
3333 37.002.
3434 (5) "Wrap-around benefits" means a service, including
3535 a pharmacy or medical benefit:
3636 (A) not covered under a private health benefit
3737 plan or a public benefit program, including Medicaid and the child
3838 health plan program, in which the child is enrolled; or
3939 (B) covered under a private health benefit plan
4040 in which the child is enrolled but the child has exceeded the
4141 private health benefit plan coverage limit.
4242 Sec. 37.002. ESTABLISHMENT OF PROGRAM. The commission,
4343 exclusive of Medicaid, by rule shall develop and implement a
4444 program under which health care services are provided to medically
4545 fragile children with a rare and unique disease or medical
4646 condition. The program must:
4747 (1) provide benefits based on a child's diagnosis; and
4848 (2) be designed to provide wrap-around benefits to
4949 children participating in the program.
5050 Sec. 37.003. ELIGIBLE CHILDREN. (a) The executive
5151 commissioner by rule shall identify the diagnoses considered rare
5252 and unique for purposes of determining eligibility under the
5353 program.
5454 (b) The executive commissioner may not impose income
5555 eligibility requirements under the program.
5656 Sec. 37.004. COVERED HEALTH CARE SERVICES. (a) Eligible
5757 health care services under the program must include:
5858 (1) specialized nutritional support, including
5959 enteral nutrition;
6060 (2) physical or occupational therapy;
6161 (3) speech therapy;
6262 (4) music therapy;
6363 (5) aqua-therapy;
6464 (6) hippotherapy;
6565 (7) private duty nursing services in home or
6666 educational environments;
6767 (8) chiropractic services; and
6868 (9) any other health care service or therapy the
6969 commission determines necessary.
7070 (b) To receive services under the program, the executive
7171 commissioner may require that a participant provide evidence:
7272 (1) from a health care provider that the proposed
7373 services are medically necessary; and
7474 (2) if the participant has private health benefit plan
7575 coverage, that:
7676 (A) the service is not covered under the plan;
7777 (B) the issuer has denied coverage under the
7878 plan; or
7979 (C) the participant has met the applicable
8080 coverage limit under the plan.
8181 Sec. 37.005. MEDICALLY FRAGILE CHILDREN ASSISTANCE PROGRAM
8282 ACCOUNT. (a) The medically fragile children assistance program
8383 account is an account in the general revenue fund.
8484 (b) The account consists of:
8585 (1) appropriations of money to the account by the
8686 legislature;
8787 (2) gifts, grants, including federal grants, and other
8888 donations received under Section 37.006; and
8989 (3) interest earned on the investment of money in the
9090 account.
9191 (c) Money in the account may be appropriated only to the
9292 commission for purposes of the program.
9393 Sec. 37.006. GIFTS, GRANTS, AND DONATIONS. The commission
9494 may accept gifts, grants, and donations from any source that are
9595 made for the purposes of the program. The commission shall deposit
9696 money received under this section to the credit of the medically
9797 fragile children assistance program account.
9898 SECTION 2. Not later than January 1, 2022, the Health and
9999 Human Services Commission shall establish the program to provide
100100 health care services to medically fragile children established
101101 under Section 37.002, Human Resources Code, as added by this Act.
102102 SECTION 3. This Act takes effect September 1, 2021.
