55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to an allotment under the public school finance system for
88 medically fragile students.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter C, Chapter 48, Education Code, is
1111 amended by adding Section 48.117 to read as follows:
1212 Sec. 48.117. ALLOTMENT FOR MEDICALLY FRAGILE STUDENTS. (a)
1313 For each student that a school district serves who has been
1414 identified as medically fragile, the district is entitled to an
1515 annual allotment equal to the basic allotment multiplied by 0.1 or a
1616 greater amount provided by appropriation.
1717 (b) A school district may receive funding for a student
1818 under this section and Section 48.102 if the student satisfies the
1919 requirements of both sections.
2020 (c) A school district may use the allotment provided for a
2121 qualifying student under this section to contract with a private
2222 provider to provide supplemental services, including private duty
2323 nursing services, to the student.
2424 SECTION 2. This Act takes effect September 1, 2021.
