9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Subchapter C, Chapter 48, Education Code, is | |
11 | 11 | amended by adding Section 48.117 to read as follows: | |
12 | 12 | Sec. 48.117. ALLOTMENT FOR MEDICALLY FRAGILE STUDENTS. (a) | |
13 | 13 | For each student that a school district serves who has been | |
14 | 14 | identified as medically fragile, the district is entitled to an | |
15 | 15 | annual allotment equal to the basic allotment multiplied by 0.1 or a | |
16 | 16 | greater amount provided by appropriation. | |
17 | 17 | (b) A school district may receive funding for a student | |
18 | 18 | under this section and Section 48.102 if the student satisfies the | |
19 | 19 | requirements of both sections. | |
20 | 20 | (c) A school district may use the allotment provided for a | |
21 | 21 | qualifying student under this section to contract with a private | |
22 | 22 | provider to provide supplemental services, including private duty | |
23 | 23 | nursing services, to the student. | |
24 | 24 | SECTION 2. This Act takes effect September 1, 2021. |
