| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter L, Chapter 43, Parks and Wildlife |
|---|
| 11 | 11 | | Code, is amended by adding Section 43.370 to read as follows: |

| 12 | 12 | | Sec. 43.370. DEER BREEDING FACILITY AFFECTED BY CHRONIC |
|---|
| 13 | 13 | | WASTING DISEASE. (a) This section applies only to a permitted deer |
|---|
| 14 | 14 | | breeding facility for which the department has obtained a chronic |
|---|
| 15 | 15 | | wasting disease test result of suspect positive for any deer at the |
|---|
| 16 | 16 | | facility. |
|---|
| 17 | 17 | | (b) As soon as the department determines that all breeder |
|---|
| 18 | 18 | | deer at a deer breeding facility described by Subsection (a) are |
|---|
| 19 | 19 | | clear of chronic wasting disease, the department shall authorize |
|---|
| 20 | 20 | | the resumption of permitted activities at the facility. |
|---|
| 21 | 21 | | (c) The commission may adopt any rules necessary to |
|---|
| 22 | 22 | | administer this section. |
|---|
| 23 | 23 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 24 | 24 | | to a deer breeding facility for which the Parks and Wildlife |
|---|
| 25 | 25 | | Department obtains a chronic wasting disease test result of suspect |
|---|
| 26 | 26 | | positive on or after the effective date of this Act. A deer |
|---|
| 27 | 27 | | breeding facility for which the department obtains a test result of |
|---|
| 28 | 28 | | suspect positive before the effective date of this Act is governed |
|---|
| 29 | 29 | | by the law in effect at the time the department obtains the suspect |
|---|
| 30 | 30 | | positive test result, and that law is continued in effect for that |
|---|
| 31 | 31 | | purpose. |
|---|
| 32 | 32 | | SECTION 3. This Act takes effect September 1, 2021. |
