55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the development of a plan to reregulate the electric
88 market in this state.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. (a) The Public Utility Commission of Texas shall
1111 develop a plan to reregulate the production and sale of electricity
1212 if, on July 1, 2021, the average price for average residential use
1313 of electricity in ERCOT is greater than the average price for
1414 average residential use of electricity in the United States.
1515 (b) The plan required by Subsection (a) of this section must
1616 include:
1717 (1) possible methods to reverse the restructuring of
1818 the electric utility industry made by Chapter 405, Acts of the 76th
1919 Legislature, Regular Session, 1999;
2020 (2) an evaluation of the effect on residential
2121 electricity prices of each method; and
2222 (3) necessary legislative changes to implement each
2323 method.
2424 (c) Not later than January 5, 2023, the Public Utility
2525 Commission of Texas shall deliver the plan to the governor,
2626 lieutenant governor, speaker of the house of representatives, and
2727 legislative committee in each house of the legislature having
2828 jurisdiction over electricity issues.
2929 SECTION 2. This Act takes effect immediately if it receives
3030 a vote of two-thirds of all the members elected to each house, as
3131 provided by Section 39, Article III, Texas Constitution. If this
3232 Act does not receive the vote necessary for immediate effect, this
3333 Act takes effect September 1, 2021.
