117 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
128 SECTION 1. Section 352.012, Local Government Code, is
13- amended by adding Subsection (c) to read as follows:
14- (c) A county that has adopted a fire code under Subchapter
15- C, Chapter 233, may require that the county fire marshal be
16- certified by the Texas Commission on Fire Protection as head of a
17- prevention only fire department.
18- SECTION 2. The change in law made by this Act applies only
19- to a fire marshal commissioned by a county on or after the effective
20- date of this Act.
21- SECTION 3. This Act takes effect September 1, 2021.
9+ amended by adding Section 352.012(c) to read as follows:
10+ QUALIFICATIONS FOR OFFICE. (a) To qualify for office, the
11+ county fire marshal must take the oath prescribed by the
12+ constitution of this state and post a bond as required by the
13+ commissioners court conditioned that the marshal will faithfully
14+ and strictly perform the duties of the office.
15+ (b) The county fire marshal may not be directly or
16+ indirectly interested in the sale of fire-fighting equipment and
17+ may not be engaged in any type of fire insurance business.
18+ (c) The county fire marshal shall meet the requirements of
19+ the Texas Commission on Fire Protection Rule §449.203 and the Texas
20+ Code of Criminal Procedure Article §2.12.
21+ SECTION 2. This Act takes effect September 1, 2021.
