| 11 | 9 | SECTION 1. Section 7.001, Local Government Code, is amended | |
| 12 | 10 | to read as follows: | |
| 13 | 11 | Sec. 7.001. AUTHORITY TO INCORPORATE AS TYPE B GENERAL-LAW | |
| 14 | 12 | MUNICIPALITY. A community may incorporate under this chapter as a | |
| 15 | 13 | Type B general-law municipality if it: | |
| 16 | 14 | (1) has proximity and contiguity between its dwellings | |
| 17 | 15 | [constitutes an unincorporated town or village]; | |
| 18 | - | (2) contains 201 to 9,999 inhabitants; | |
| 16 | + | (2) contains 201 to 9,999 inhabitants; and | |
| 19 | 17 | (3) meets the territorial requirements prescribed by | |
| 20 | - | Section 5.901; and | |
| 21 | - | (4) has a population density of at least 100 | |

| 33 | 29 | described by Paragraph (A). | |
| 34 | 30 | SECTION 3. Section 7.003, Local Government Code, is amended | |

| 36 | 32 | Sec. 7.003. ELECTION ORDER. If satisfactory proof is made | |
