| 5 | 11 | | relating to the qualifications of directors of certain municipal |
|---|
| 6 | 12 | | development districts. |
|---|
| 7 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 8 | 14 | | SECTION 1. Section 377.051(e), Local Government Code, is |
|---|
| 9 | 15 | | amended to read as follows: |
|---|
| 10 | 16 | | (e) Notwithstanding Subsection (d), a person may qualify to |
|---|
| 11 | 17 | | serve as a director of a district if the person resides in the |
|---|
| 12 | 18 | | independent school district that serves the majority of the |
|---|
| 13 | 19 | | district and the district [that] is located in a municipality: |
|---|
| 14 | 20 | | (1) with a population of more than 5,000 and less than |
|---|
| 15 | 21 | | 6,000 and that is located wholly in a county with a population of |
|---|
| 16 | 22 | | more than 20,000 and less than 25,000 and that borders the Brazos |
|---|
| 17 | 23 | | River; or |
|---|
| 18 | 24 | | (2) with a population of more than 1,488 and less than |
|---|
| 19 | 25 | | 2,500 and that is located wholly in a county with a population of |
|---|
| 20 | 26 | | more than 20,000 and less than 30,000 that borders the Neches River |
|---|
| 21 | 27 | | and the Trinity River [if the person resides in the independent |
|---|
| 22 | 28 | | school district that serves the majority of the district]. |

| 23 | 29 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 24 | 30 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 25 | 31 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 26 | 32 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 27 | 33 | | Act takes effect September 1, 2021. |
