8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Section 12.106, Education Code, is amended by | |
10 | 10 | adding Subsection (k) to read as follows: | |
11 | 11 | (k) Notwithstanding any other provision of this section, | |
12 | 12 | the total amount of funding per student in weighted average daily | |
13 | 13 | attendance to which a charter holder may be entitled for an | |
14 | 14 | open-enrollment charter school under this section may not exceed | |
15 | 15 | the total amount of state and local revenue, including maintenance | |
16 | 16 | and operations revenue and revenue for debt service, per student in | |
17 | 17 | weighted average daily attendance of the school district within | |
18 | 18 | whose boundaries the charter holder's campus with the greatest | |
19 | 19 | enrollment is located. If a charter holder's funding would exceed | |
20 | 20 | that amount, the amount of funding to which the charter holder would | |
21 | 21 | otherwise be entitled under this section shall be reduced to comply | |
22 | 22 | with the maximum amount of funding described by this subsection. | |
23 | 23 | SECTION 2. This Act takes effect September 1, 2021. |
