66 AN ACT
77 relating to funding for open-enrollment charter schools.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 12.106, Education Code, is amended by
1010 adding Subsection (k) to read as follows:
1111 (k) Notwithstanding any other provision of this section,
1212 the total amount of funding per student in weighted average daily
1313 attendance to which a charter holder may be entitled for an
1414 open-enrollment charter school under this section may not exceed
1515 the total amount of state and local revenue, including maintenance
1616 and operations revenue and revenue for debt service, per student in
1717 weighted average daily attendance of the school district within
1818 whose boundaries the charter holder's campus with the greatest
1919 enrollment is located. If a charter holder's funding would exceed
2020 that amount, the amount of funding to which the charter holder would
2121 otherwise be entitled under this section shall be reduced to comply
2222 with the maximum amount of funding described by this subsection.
2323 SECTION 2. This Act takes effect September 1, 2021.
