| 7 | 7 | | relating to examinations for applicants for or holders of licenses |

| 8 | 8 | | or registrations to perform certain activities pertaining to |
|---|
| 9 | 9 | | compressed natural gas or liquefied natural gas. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Sections 113.087(a), (j), and (k), Natural |
|---|
| 12 | 12 | | Resources Code, are amended to read as follows: |
|---|
| 13 | 13 | | (a) The satisfactory completion of the requirements of this |
|---|
| 14 | 14 | | section is mandatory, and operations requiring an LP-gas license |
|---|
| 15 | 15 | | may not commence, continue, or resume unless examination and |
|---|
| 16 | 16 | | seminar requirements are fulfilled. The commission shall prepare, |
|---|
| 17 | 17 | | administer, and grade or review an examination required by this |
|---|
| 18 | 18 | | section or contract with a testing or proctoring service to |
|---|
| 19 | 19 | | prepare, administer, and grade or review the examination. |
|---|
| 20 | 20 | | (j) If the examination is graded or reviewed by a testing or |
|---|
| 21 | 21 | | proctoring service: |
|---|
| 22 | 22 | | (1) the commission shall notify the person of the |
|---|
| 23 | 23 | | results of the examination not later than the 14th day after the |
|---|
| 24 | 24 | | date the commission receives the results from the testing or |
|---|
| 25 | 25 | | proctoring service; and |
|---|
| 26 | 26 | | (2) if notice of the examination results will be |
|---|
| 27 | 27 | | delayed for longer than 90 days after the examination date, the |
|---|
| 28 | 28 | | commission shall notify the person of the reason for the delay |
|---|
| 29 | 29 | | before the 90th day. |
|---|
| 30 | 30 | | (k) The commission may require a testing or proctoring |
|---|
| 31 | 31 | | service to notify a person of the results of the person's |
|---|
| 32 | 32 | | examination. |
|---|
| 33 | 33 | | SECTION 2. Section 113.088(b), Natural Resources Code, is |
|---|
| 34 | 34 | | amended to read as follows: |
|---|
| 35 | 35 | | (b) Before seminar attendance or examination of any person, |
|---|
| 36 | 36 | | except as provided by [this subsection or] Subsection (c), the |
|---|
| 37 | 37 | | commission shall receive a nonrefundable fee for each examination |
|---|
| 38 | 38 | | or seminar registration. [If the examination is administered by a |
|---|
| 39 | 39 | | testing service, the testing service may administer the examination |
|---|
| 40 | 40 | | before the commission receives the fee. A testing service that |
|---|
| 41 | 41 | | administers an examination shall collect a nonrefundable fee for |
|---|
| 42 | 42 | | the examination before the examination is administered and shall |
|---|
| 43 | 43 | | forward the fee to the commission not later than the fifth business |
|---|
| 44 | 44 | | day after the date the testing service receives the fee.] |
|---|
| 45 | 45 | | SECTION 3. Sections 116.034(e) and (f), Natural Resources |
|---|
| 46 | 46 | | Code, are amended to read as follows: |
|---|
| 47 | 47 | | (e) If the examination is graded or reviewed by a testing or |
|---|
| 48 | 48 | | proctoring service: |
|---|
| 49 | 49 | | (1) the commission shall notify the person of the |
|---|
| 50 | 50 | | results of the examination not later than the 14th day after the |
|---|
| 51 | 51 | | date the commission receives the results from the testing or |
|---|
| 52 | 52 | | proctoring service; and |
|---|
| 53 | 53 | | (2) if notice of the examination results will be |
