55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to examinations for applicants for or holders of licenses
88 or registrations to perform certain activities pertaining to
99 compressed natural gas or liquefied natural gas.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Sections 113.087(a), (j), and (k), Natural
1212 Resources Code, are amended to read as follows:
1313 (a) The satisfactory completion of the requirements of this
1414 section is mandatory, and operations requiring an LP-gas license
1515 may not commence, continue, or resume unless examination and
1616 seminar requirements are fulfilled. The commission shall prepare,
1717 administer, and grade or review an examination required by this
1818 section or contract with a testing or proctoring service to
1919 prepare, administer, and grade or review the examination.
2020 (j) If the examination is graded or reviewed by a testing or
2121 proctoring service:
2222 (1) the commission shall notify the person of the
2323 results of the examination not later than the 14th day after the
2424 date the commission receives the results from the testing or
2525 proctoring service; and
2626 (2) if notice of the examination results will be
2727 delayed for longer than 90 days after the examination date, the
2828 commission shall notify the person of the reason for the delay
2929 before the 90th day.
3030 (k) The commission may require a testing or proctoring
3131 service to notify a person of the results of the person's
3232 examination.
3333 SECTION 2. Section 113.088(b), Natural Resources Code, is
3434 amended to read as follows:
3535 (b) Before seminar attendance or examination of any person,
3636 except as provided by [this subsection or] Subsection (c), the
3737 commission shall receive a nonrefundable fee for each examination
3838 or seminar registration. [If the examination is administered by a
3939 testing service, the testing service may administer the examination
4040 before the commission receives the fee. A testing service that
4141 administers an examination shall collect a nonrefundable fee for
4242 the examination before the examination is administered and shall
4343 forward the fee to the commission not later than the fifth business
4444 day after the date the testing service receives the fee.]
4545 SECTION 3. Sections 116.034(e) and (f), Natural Resources
4646 Code, are amended to read as follows:
4747 (e) If the examination is graded or reviewed by a testing or
4848 proctoring service:
4949 (1) the commission shall notify the person of the
5050 results of the examination not later than the 14th day after the
5151 date the commission receives the results from the testing or
5252 proctoring service; and
5353 (2) if notice of the examination results will be
5454 delayed for longer than 90 days after the examination date, the
5555 commission shall notify the person of the reason for the delay
5656 before the 90th day.
5757 (f) The commission may require a testing or proctoring
5858 service to notify a person of the results of the person's
5959 examination.
6060 SECTION 4. This Act takes effect September 1, 2021.
