95 A BILL TO BE ENTITLED
106 AN ACT
117 relating to providing information to undergraduate students
128 regarding certain fixed or flat tuition rates provided by certain
139 institutions of higher education.
1410 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1511 SECTION 1. Section 54.016, Education Code, is amended by
1612 adding Subsection (d) to read as follows:
1713 (d) A general academic teaching institution that offers a
1814 fixed tuition rate program under this section shall provide
1915 information explaining the effect of the program on the calculation
2016 of a student's cost per credit hour, including the institution's
2117 current fixed tuition rate, and clearly describing the amount of
2218 tuition a student would pay for varying course loads covered by the
2319 program:
2420 (1) to each transferring undergraduate student, at the
2521 time the student is offered the opportunity to participate in the
2622 institution's fixed tuition rate program;
2723 (2) for a student enrolled in the institution's fixed
2824 tuition rate program, in materials or correspondence provided to
2925 the student each time the student registers for a semester or other
3026 term and in each tuition billing statement;
3127 (3) on the institution's Internet website; and
3228 (4) in any financial aid information provided to
3329 students.
3430 SECTION 2. Section 54.017, Education Code, is amended by
3531 adding Subsection (h) to read as follows:
3632 (h) An institution to which this section applies shall
3733 provide information explaining the effect of the fixed tuition
3834 price plan on the calculation of a student's cost per credit hour,
3935 including the institution's current fixed tuition rate, and clearly
4036 describing the amount of tuition a student would pay for varying
4137 course loads covered by the plan:
4238 (1) to each entering undergraduate student, at the
4339 time the student is offered the opportunity to participate in the
4440 institution's fixed tuition price plan;
4541 (2) for a student enrolled in the institution's fixed
4642 tuition price plan, in materials or correspondence provided to the
4743 student each time the student registers for a semester or other term
4844 and in each tuition billing statement;
4945 (3) on the institution's Internet website; and
5046 (4) in any financial aid information provided to
5147 students.
5248 SECTION 3. Subchapter A, Chapter 54, Education Code, is
5349 amended by adding Section 54.018 to read as follows:
5450 Sec. 54.018. FLAT-RATE TUITION PLAN. (a) In this section,
5551 "institution of higher education" has the meaning assigned by
5652 Section 61.003.
5753 (b) An institution of higher education that offers a
5854 flat-rate tuition plan under which the institution charges a
5955 student for a specified number of credit hours regardless of the
6056 number of credit hours in which the student enrolls shall provide
6157 information explaining the effect of the flat-rate tuition plan on
6258 the calculation of a student's cost per credit hour, including the
6359 institution's current flat rate of tuition, and clearly describing
6460 the amount of tuition a student would pay for varying course loads
6561 covered by the plan:
6662 (1) to each entering undergraduate student;
6763 (2) in materials or correspondence provided to the
6864 student each time the student registers for a semester or other term
6965 and in each tuition billing statement;
7066 (3) on the institution's Internet website; and
7167 (4) in any financial aid information provided to
7268 students.
7369 SECTION 4. This Act takes effect September 1, 2021.
