9	5		A BILL TO BE ENTITLED
10	6		AN ACT
11	7		relating to providing information to undergraduate students
12	8		regarding certain fixed or flat tuition rates provided by certain
13	9		institutions of higher education.
14	10		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
15	11		SECTION 1. Section 54.016, Education Code, is amended by
16	12		adding Subsection (d) to read as follows:
17	13		(d) A general academic teaching institution that offers a
18	14		fixed tuition rate program under this section shall provide
19	15		information explaining the effect of the program on the calculation
20	16		of a student's cost per credit hour, including the institution's
21	17		current fixed tuition rate, and clearly describing the amount of
22	18		tuition a student would pay for varying course loads covered by the
23	19		program:
24	20		(1) to each transferring undergraduate student, at the
25	21		time the student is offered the opportunity to participate in the
26	22		institution's fixed tuition rate program;
27	23		(2) for a student enrolled in the institution's fixed
28	24		tuition rate program, in materials or correspondence provided to
29	25		the student each time the student registers for a semester or other
30	26		term and in each tuition billing statement;
31	27		(3) on the institution's Internet website; and
32	28		(4) in any financial aid information provided to
33	29		students.
34	30		SECTION 2. Section 54.017, Education Code, is amended by
35	31		adding Subsection (h) to read as follows:
36	32		(h) An institution to which this section applies shall
37	33		provide information explaining the effect of the fixed tuition
38	34		price plan on the calculation of a student's cost per credit hour,
39	35		including the institution's current fixed tuition rate, and clearly
40	36		describing the amount of tuition a student would pay for varying
41	37		course loads covered by the plan:
42	38		(1) to each entering undergraduate student, at the
43	39		time the student is offered the opportunity to participate in the
44	40		institution's fixed tuition price plan;
45	41		(2) for a student enrolled in the institution's fixed
46	42		tuition price plan, in materials or correspondence provided to the
47	43		student each time the student registers for a semester or other term
48	44		and in each tuition billing statement;
49	45		(3) on the institution's Internet website; and
50	46		(4) in any financial aid information provided to
51	47		students.
52	48		SECTION 3. Subchapter A, Chapter 54, Education Code, is
53	49		amended by adding Section 54.018 to read as follows:
54	50		Sec. 54.018. FLAT-RATE TUITION PLAN. (a) In this section,
55	51		"institution of higher education" has the meaning assigned by
56	52		Section 61.003.
57	53		(b) An institution of higher education that offers a
58	54		flat-rate tuition plan under which the institution charges a
59	55		student for a specified number of credit hours regardless of the
60	56		number of credit hours in which the student enrolls shall provide
61	57		information explaining the effect of the flat-rate tuition plan on
62	58		the calculation of a student's cost per credit hour, including the
63	59		institution's current flat rate of tuition, and clearly describing
64	60		the amount of tuition a student would pay for varying course loads
65	61		covered by the plan:
66	62		(1) to each entering undergraduate student;
67	63		(2) in materials or correspondence provided to the
68	64		student each time the student registers for a semester or other term
69	65		and in each tuition billing statement;
70	66		(3) on the institution's Internet website; and
71	67		(4) in any financial aid information provided to
72	68		students.
73	69		SECTION 4. This Act takes effect September 1, 2021.
