44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to reemployment protections for certain members of the
77 military.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter B, Chapter 613, Government Code, is
1010 amended by adding Section 613.024 to read as follows:
1111 Sec. 613.024. ENFORCEMENT OF RIGHTS WITH RESPECT TO STATE
1212 OR PRIVATE EMPLOYER. An employee may bring suit in district court
1313 against the state or local government under the federal Uniformed
1414 Services Employment and Reemployment Rights Act to enforce their
1515 rights and benefits under that act.
1616 SECTION 2. Subchapter B, Chapter 613, Government Code, is
1717 amended by adding Section 613.025 to read as follows:
1818 Sec. 613.025. REMEDIES. In any action under this section,
1919 the court may award relief as follows:
2020 (1) The court may require the employer to comply with
2121 the provisions of this chapter.
2222 (2) The court may require the employer to compensate
2323 the person for any loss of wages or benefits suffered by reason of
2424 such employer's failure to comply with the provisions of this
2525 chapter.
2626 (3) The court may require the employer to pay the
2727 person an amount equal to the amount referred to in subparagraph (2)
2828 as liquidated damages, if the court determines that the employer's
2929 failure to comply with the provisions of this chapter was willful.
3030 Sec. 613.026. SOVEREIGN IMMUNITY WAIVED. Sovereign
3131 immunity to suit is waived and abolished to the extent of liability
3232 created by this chapter or under the federal Uniformed Services
3333 Employment and Reemployment Rights Act. A person may sue the state
3434 or a local governmental entity for damages allowed by this chapter
3535 or under the federal Uniformed Services Employment and Reemployment
3636 Rights Act.
3737 SECTION 3. This Act takes effect immediately if it receives
3838 a vote of two-thirds of all the members elected to each house, as
3939 provided by Section 39, Article III, Texas Constitution. If this
4040 Act does not receive the vote necessary for immediate effect, this
4141 Act takes effect September 1, 2021.
