55 AN ACT
66 relating to plans by a school district or open-enrollment charter
77 school for mitigating student learning loss due to the coronavirus
88 disease (COVID-19) pandemic.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 29, Education Code, is amended by adding
1111 Subchapter O to read as follows:
1212 SUBCHAPTER O. PLANS FOR MITIGATING LEARNING LOSS DUE TO COVID-19
1313 PANDEMIC
1414 Sec. 29.601. DEFINITIONS. In this subchapter:
1515 (1) "Learning loss" means any specific or general loss
1616 of knowledge and skills or reversals in academic progress.
1717 Sec. 29.602. SCHOOL YEARS AFFECTED BY CORONAVIRUS DISEASE.
1818 For purposes of this subchapter, the school years affected by the
1919 coronavirus disease (COVID-19) pandemic include:
2020 (1) the 2020-2021 school year;
2121 (2) the 2021-2022 school year; and
2222 (3) the 2022-2023 school year.
2323 Sec. 29.603. LEARNING LOSS IDENTIFICATION. Each school
2424 district and open-enrollment charter school shall identify each
2525 student enrolled in the district or school who has experienced
2626 learning loss during any school year affected by the coronavirus
2727 disease pandemic.
2828 Sec. 29.604. PLANS FOR MITIGATING LEARNING LOSS.
2929 (a) Each school district and open-enrollment charter school
3030 shall develop a plan to mitigate student learning loss as a result
3131 of the coronavirus disease (COVID-19) pandemic.
3232 (b) A school district or an open-enrollment charter school
3333 shall make the methods included in the learning loss plan available
3434 to any student identified as having experienced learning loss under
3535 Section 29.603.
3636 (c) A school district or an open-enrollment charter school
3737 may prioritize any students that the district or school has
3838 identified as most affected by the coronavirus disease pandemic.
3939 Sec. 29.605 FUNDING TO IMPLEMENT PLANS TO MITIGATE LEARNING
4040 LOSS. (a) The agency shall make federal funds available to school
4141 districts and open-enrollment charter schools to implement the
4242 plans developed under Sec. 29.604.
4343 Sec. 29.606. RULES. The commissioner shall adopt necessary
4444 rules to implement this subchapter.
4545 Sec. 29.607. EXPIRATION. This subchapter expires September
4646 1, 2025.
4747 SECTION 2. This Act takes effect immediately if it receives
4848 a vote of two-thirds of all the members elected to each house, as
4949 provided by Section 39, Article III, Texas Constitution. If this
5050 Act does not receive the vote necessary for immediate effect, this
5151 Act takes effect September 1, 2021.
