| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 29, Education Code, is amended by adding |
|---|
| 11 | 11 | | Subchapter O to read as follows: |
|---|
| 12 | 12 | | SUBCHAPTER O. PLANS FOR MITIGATING LEARNING LOSS DUE TO COVID-19 |
|---|
| 13 | 13 | | PANDEMIC |
|---|
| 14 | 14 | | Sec. 29.601. DEFINITIONS. In this subchapter: |
|---|
| 15 | 15 | | (1) "Learning loss" means any specific or general loss |
|---|
| 16 | 16 | | of knowledge and skills or reversals in academic progress. |
|---|
| 17 | 17 | | Sec. 29.602. SCHOOL YEARS AFFECTED BY CORONAVIRUS DISEASE. |
|---|
| 18 | 18 | | For purposes of this subchapter, the school years affected by the |
|---|
| 19 | 19 | | coronavirus disease (COVID-19) pandemic include: |
|---|
| 20 | 20 | | (1) the 2020-2021 school year; |
|---|
| 21 | 21 | | (2) the 2021-2022 school year; and |
|---|
| 22 | 22 | | (3) the 2022-2023 school year. |
|---|
| 23 | 23 | | Sec. 29.603. LEARNING LOSS IDENTIFICATION. Each school |
|---|
| 24 | 24 | | district and open-enrollment charter school shall identify each |
|---|
| 25 | 25 | | student enrolled in the district or school who has experienced |
|---|
| 26 | 26 | | learning loss during any school year affected by the coronavirus |
|---|
| 27 | 27 | | disease pandemic. |
|---|
| 28 | 28 | | Sec. 29.604. PLANS FOR MITIGATING LEARNING LOSS. |
|---|
| 29 | 29 | | (a) Each school district and open-enrollment charter school |
|---|
| 30 | 30 | | shall develop a plan to mitigate student learning loss as a result |
|---|
| 31 | 31 | | of the coronavirus disease (COVID-19) pandemic. |
|---|
| 32 | 32 | | (b) A school district or an open-enrollment charter school |
|---|
| 33 | 33 | | shall make the methods included in the learning loss plan available |
|---|
| 34 | 34 | | to any student identified as having experienced learning loss under |
|---|
| 35 | 35 | | Section 29.603. |
|---|
| 36 | 36 | | (c) A school district or an open-enrollment charter school |
|---|
| 37 | 37 | | may prioritize any students that the district or school has |
|---|
| 38 | 38 | | identified as most affected by the coronavirus disease pandemic. |
|---|
| 39 | 39 | | Sec. 29.605 FUNDING TO IMPLEMENT PLANS TO MITIGATE LEARNING |
|---|
| 40 | 40 | | LOSS. (a) The agency shall make federal funds available to school |
|---|
| 41 | 41 | | districts and open-enrollment charter schools to implement the |
|---|
| 42 | 42 | | plans developed under Sec. 29.604. |
|---|
| 43 | 43 | | Sec. 29.606. RULES. The commissioner shall adopt necessary |
|---|
| 44 | 44 | | rules to implement this subchapter. |
|---|
| 45 | 45 | | Sec. 29.607. EXPIRATION. This subchapter expires September |
|---|
| 46 | 46 | | 1, 2025. |
|---|
| 47 | 47 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 48 | 48 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 49 | 49 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 50 | 50 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 51 | 51 | | Act takes effect September 1, 2021. |
