| 7 | 7 | | relating to distributions to the state greyhound breed registry. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Sections 2028.202(c) and (e), Occupations Code, |
|---|
| 10 | 10 | | are amended to read as follows: |
|---|
| 11 | 11 | | (c) From the total amount deducted under Subsection (a), a |
|---|
| 12 | 12 | | horse racetrack association that receives an interstate |
|---|
| 13 | 13 | | cross-species simulcast signal shall distribute [the following |
|---|
| 14 | 14 | | amounts] from each pool wagered on the signal at the racetrack[: |
|---|
| 15 | 15 | | [(1)] a fee of 1.5 percent to be paid to the racetrack |
|---|
| 16 | 16 | | in this state sending the signal[; and |
|---|
| 17 | 17 | | [(2) a purse in the amount of 5.5 percent to be paid to |
|---|
| 18 | 18 | | the official state greyhound breed registry for use at racetracks |
|---|
| 19 | 19 | | in this state]. |
|---|
| 20 | 20 | | (e) A racetrack association offering wagering on an |
|---|
| 21 | 21 | | intrastate cross-species simulcast signal shall send the purse |
|---|
| 22 | 22 | | amount specified under Subsection (b)(4) [or (c)(2), as |
|---|
| 23 | 23 | | appropriate,] to the racetrack conducting the live race that is |
|---|
| 24 | 24 | | being simulcast. |

| 25 | 25 | | SECTION 2. Section 2027.055(a), Occupations Code, is |
|---|
| 26 | 26 | | amended to read as follows: |
|---|
| 27 | 27 | | (a) Except as provided by this subchapter, a horse racetrack |
|---|
| 28 | 28 | | may offer wagering on interstate greyhound race simulcast signals |
|---|
| 29 | 29 | | only as provided by a contract with the nearest greyhound |
|---|
| 30 | 30 | | racetrack. If an agreement between the racetracks cannot be |
|---|
| 31 | 31 | | reached by October 1 of the year preceding the calendar year in |
|---|
| 32 | 32 | | which the simulcasting is to occur, the horse racetrack may |
|---|
| 33 | 33 | | purchase and offer wagering on greyhound race simulcast signals and |
|---|
| 34 | 34 | | shall pay to the nearest greyhound racetrack the amounts specified |
|---|
| 35 | 35 | | under Section 2028.202(c) [2028.202(c)(1)]. |
|---|
| 36 | 36 | | SECTION 3. The following provisions of the Occupations Code |
|---|
| 37 | 37 | | are repealed: |
|---|
| 38 | 38 | | (1) Section 2028.202(d); |
|---|
| 39 | 39 | | (2) Section 2028.154; and |
|---|
| 40 | 40 | | (3) Section 2030.053. |
|---|
| 41 | 41 | | SECTION 4. As soon as practicable after the effective date |
|---|
| 42 | 42 | | of this Act, the Texas Racing Commission shall adopt the rules |
|---|
| 43 | 43 | | necessary to comply with Subtitle A-1, Title 13, Occupations Code |
|---|
| 44 | 44 | | (Texas Racing Act), as amended by this Act. |
|---|
| 45 | 45 | | SECTION 5. This Act takes effect September 1, 2021. |
