8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Subchapter Z, Chapter 39, Utilities Code, is | |
10 | 10 | amended by adding Section 39.9031 to read as follows: | |
11 | 11 | Sec. 39.9031. DISASTER BILL PAYMENT ASSISTANCE. (a) The | |
12 | 12 | commission by rule shall direct municipally owned utilities, | |
13 | 13 | electric cooperatives, and retail electric providers in the ERCOT | |
14 | 14 | power region to waive any bill increases for retail electric | |
15 | 15 | customers who receive an unusually high bill for services provided | |
16 | 16 | during a state of disaster or emergency declared by the president of | |
17 | 17 | the United States or a state of disaster declared by the governor | |
18 | 18 | under Chapter 418, Government Code; | |
19 | 19 | SECTION 2. This Act takes effect immediately if it receives | |
20 | 20 | a vote of two-thirds of all the members elected to each house, as | |
21 | 21 | provided by Section 39, Article III, Texas Constitution. If this | |
22 | 22 | Act does not receive the vote necessary for immediate effect, this | |
23 | 23 | Act takes effect September 1, 2021. |
