6	6	relating to the consolidation and allocation of state civil court
7	7	costs; increasing certain civil court costs.
8	8	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	9	SECTION 1. Section 22.2021(b), Government Code, is amended
10	10	to read as follows:
11	11	(b) To fund the system, the commissioners court shall use
12	12	the court costs fee collected as provided by Sections 133.151(a)(6)
13	13	and 133.1511(a)(4), Local Government Code, [ set a court costs fee
14	14	of not more than $5] for each civil suit filed in county court,
15	15	county court at law, probate court, or district court in the county.
16	16	SECTION 2. Section 22.2031(b), Government Code, is amended
17	17	to read as follows:
18	18	(b) To fund the system, the commissioners court shall use
19	19	the court costs fee collected as provided by Sections 133.151(a)(6)
20	20	and 133.1511(a)(4), Local Government Code, [set a court costs fee
21	21	of $5] for each civil suit filed in county court, statutory county
22	22	court, statutory probate court, or district court in the county.
23	23	SECTION 3. Section 22.2041(b), Government Code, is amended
24	24	to read as follows:
25	25	(b) To fund the system, the commissioners court shall use

72	72	SECTION 10. Subchapter C, Chapter 22, Government Code, is
73	73	amended by adding Section 22.2111 to read as follows:
74	74	Sec. 22.2111. APPELLATE JUDICIAL SYSTEM. (a) The
75	75	commissioners court of each county in the Tenth Court of Appeals
76	76	District by order entered in its minutes shall establish an
77	77	appellate judicial system to:
78	78	(1) assist the court of appeals for the county in the
79	79	processing of appeals filed with the court of appeals from the
80	80	county courts, statutory county courts, statutory probate courts,
81	81	and district courts; and
82	82	(2) defray costs and expenses incurred in the
83	83	operation of the court of appeals.
84	84	(b) To fund the system, the commissioners court shall use
85	85	the court costs fee collected as provided by Sections 133.151(a)(6)
86	86	and 133.1511(a)(4), Local Government Code, for each civil suit
87	87	filed in county court, statutory county court, statutory probate
88	88	court, or district court in the county.
89	89	(c) The court costs fee does not apply to a suit filed by any
90	90	governmental entity or to a suit for delinquent taxes.
91	91	(d) The court costs fee shall be taxed, collected, and paid
92	92	as other court costs in a suit. The clerk of the court shall collect
93	93	the court costs fee set under this section and pay it to the county
94	94	officer who performs the county treasurer's functions. That officer
95	95	shall deposit the fee in a separate appellate judicial system fund
96	96	for the court of appeals district. The fund may not be used for any
97	97	other purpose.
98	98	(e) The funds collected under this section must be forwarded
99	99	monthly to the court of appeals for expenditure by the court of
100	100	appeals.
101	101	(f) The chief justice of the court of appeals is responsible
102	102	for management of the funds forwarded to the court of appeals under
103	103	this section and has sole discretion as to the use of the funds,
104	104	except that the funds must be used for purposes consistent with the
105	105	purposes of the appellate judicial system as described by
106	106	Subsection (a).
107	107	SECTION 11. Section 22.2121(b), Government Code, is amended
108	108	to read as follows:
109	109	(b) To fund the system, the commissioners court shall use
110	110	the court costs fee collected as provided by Sections 133.151(a)(6)
111	111	and 133.1511(a)(4), Local Government Code, [set a court costs fee
112	112	of $5] for each civil suit filed in county court, statutory county
113	113	court, probate court, or district court in the county.
114	114	SECTION 12. Section 22.2131(b), Government Code, is amended
115	115	to read as follows:
116	116	(b) To fund the system, the commissioners court shall use
117	117	the court costs fee collected as provided by Sections 133.151(a)(6)
118	118	and 133.1511(a)(4), Local Government Code, [set a court costs fee
119	119	of $5] for each civil suit filed in county court, statutory county
120	120	court, probate court, or district court in the county.
121	121	SECTION 13. Section 22.2141(b), Government Code, is amended
122	122	to read as follows:
123	123	(b) To fund the system, the commissioners court shall use
124	124	the court costs fee collected as provided by Sections 133.151(a)(6)
125	125	and 133.1511(a)(4), Local Government Code, [set a court costs fee
126	126	of not more than $5] for each civil suit filed in a county court,
127	127	county court at law, probate court, or district court in the county.
128	128	SECTION 14. Section 26.007(a), Government Code, is amended
129	129	to read as follows:
130	130	(a) Beginning on the first day of the state fiscal year, the
131	131	state shall annually compensate each county that collects the
132	132	additional fees and costs under Section 51.703 of this code or
133	133	Section 133.1511(d), Local Government Code, in an amount equal to
134	134	$5,000 if the county judge is entitled to an annual salary
135	135	supplement from the state under Section 26.006.
136	136	SECTION 15. Sections 51.702(c) and (d), Government Code,
137	137	are amended to read as follows:
138	138	(c) Court costs and fees due under this section or Section
139	139	133.1511(c), Local Government Code, shall be collected in the same
140	140	manner as other fees, fines, or costs are collected in the case.
141	141	(d) The clerk shall deposit the fees and costs collected
142	142	under this section or Section 133.1511(c), Local Government Code,
143	143	to be sent to the comptroller as provided by Subchapter B, Chapter
144	144	133, Local Government Code. The comptroller shall deposit the fees
145	145	in the judicial fund.
146	146	SECTION 16. Sections 51.703(c), (d), and (f), Government
147	147	Code, are amended to read as follows:
148	148	(c) Court costs and fees due under this section or Section
149	149	133.1511(d), Local Government Code, shall be collected in the same
150	150	manner as other fees, fines, or costs are collected in the case.
151	151	(d) The clerk shall deposit the fees and costs collected
152	152	under this section or Section 133.1511(d), Local Government Code,
153	153	to be sent to the comptroller as provided by Subchapter B, Chapter
154	154	133, Local Government Code. The comptroller shall deposit the fees
155	155	in the judicial fund.
156	156	(f) A clerk may not collect a fee under Section 133.1511(d),
157	157	Local Government Code, [this section] and under Section
158	158	133.1511(c), Local Government Code [51.702(a)].
159	159	SECTION 17. Sections 51.704(b), (c), and (i), Government
160	160	Code, are amended to read as follows:
161	161	(b) Court fees due under Section 133.1511(e), Local
162	162	Government Code, [this section] shall be collected in the same
163	163	manner as other fees, fines, or costs are collected in the case.
164	164	(c) The clerk shall deposit the fees collected under Section
165	165	133.1511(e), Local Government Code, [this section] to be sent to
166	166	the comptroller as provided by Subchapter B, Chapter 133, Local
167	167	Government Code. The comptroller shall deposit the fees in the
168	168	judicial fund.
169	169	(i) A clerk may not collect a fee under Section 133.1511(e),
170	170	Local Government Code, [this section] and under Section [51.701 or]
171	171	51.702 of this code or Section 133.1511(c), Local Government Code.
172	172	SECTION 18. Sections 51.851(b), (c), (e), (f), (g), (i),
173	173	(j), and (k), Government Code, are amended to read as follows:
174	174	(b) In addition to other fees authorized or required by law,
175	175	the clerk of the supreme court or[,] a court of appeals[, a district
176	176	court, a county court, a statutory county court, or a statutory
177	177	probate court] shall collect a $30 fee on the filing of any civil
178	178	[action or proceeding requiring a filing fee, including an]
179	179	appeal[, and on the filing of any counterclaim, cross-action,
180	180	intervention, interpleader, or third-party action requiring a
181	181	filing fee] to be used as provided by Section 51.852. A fee
182	182	authorized by Section 133.151(a)(4) or 133.1511(a)(2), Local
183	183	Government Code, by a district court, a county court, a statutory
184	184	county court, or a statutory probate court on the filing of any
185	185	civil action or proceeding requiring a filing fee and on the filing
186	186	of any counterclaim, cross-action, intervention, interpleader, or
187	187	third-party action requiring a filing fee shall be used as provided
188	188	by Section 51.852.
189	189	(c) A fee authorized by Section 133.1512(2), Local
190	190	Government Code, [In addition to other fees authorized or required
191	191	by law, the clerk of a justice court shall collect a $10 fee] on the
192	192	filing of any civil action or proceeding requiring a filing fee,
193	193	including an appeal, and on the filing of any counterclaim,
194	194	cross-action, intervention, interpleader, or third-party action
195	195	requiring a filing fee shall [to] be used as provided by Section
196	196	51.852.
197	197	(e) A court may waive payment of a court cost or fee due
198	198	under this section or Section 133.151(a)(4), 133.1511(a)(2), or
199	199	133.1512(2), Local Government Code, for an individual the court
200	200	determines is indigent.
201	201	(f) Court costs and fees due under this section or Section
202	202	133.151(a)(4), 133.1511(a)(2), or 133.1512(2), Local Government
203	203	Code, shall be collected in the same manner as other fees, fines, or
204	204	costs in the case.
205	205	(g) The clerk of a district court, a county court, a
206	206	statutory county court, a statutory probate court, or a justice
207	207	court shall deposit the court costs and fees collected under this
208	208	section or Section 133.151(a)(4), 133.1511(a)(2), or 133.1512(2),
209	209	Local Government Code, in the appropriate local treasury and remit
210	210	the court costs and fees to the comptroller in the manner provided
211	211	by Subchapter B, Chapter 133, Local Government Code.
212	212	(i) The comptroller shall deposit the court costs and fees
213	213	received under this section or Section 133.151(a)(4),
214	214	133.1511(a)(2), or 133.1512(2), Local Government Code, to the
215	215	credit of the statewide electronic filing system fund established
216	216	under Section 51.852.
217	217	(j) The comptroller may audit the records of a county
218	218	related to costs and fees collected under this section or Section
219	219	133.151(a)(4), 133.1511(a)(2), or 133.1512(2), Local Government
220	220	Code.
221	221	(k) Money spent from costs and fees collected under this
222	222	section or Section 133.151(a)(4), 133.1511(a)(2), or 133.1512(2),
223	223	Local Government Code, is subject to audit by the state auditor.
224	224	SECTION 19. Section 51.971, Government Code, is amended to
225	225	read as follows:
226	226	Sec. 51.971. JUDICIAL AND COURT PERSONNEL TRAINING FEE.
227	227	(a) A filing fee required by Section 133.151(a)(5),
228	228	133.1151(a)(3), or 133.1152(3), Local Government Code, is [In
229	229	addition to other fees authorized or required by law, the clerk of a
230	230	district court, county court, statutory county court, statutory
231	231	probate court, or justice court shall collect a $5 fee on the filing
232	232	of any civil action or proceeding requiring a filing fee, including
233	233	an appeal, and on the filing of any counterclaim, cross-action,
234	234	intervention, interpleader, or third party action requiring a
235	235	filing fee] to be used as provided under Section 56.003.

245	245	county court, statutory probate court, or justice court shall
246	246	deposit the court costs and fees collected under Section
247	247	133.151(a)(5), 133.1151(a)(3), or 133.1152(3), Local Government
248	248	Code, [this section] in the appropriate local treasury and remit
249	249	the court costs and fees to the comptroller in the manner provided
250	250	under Subchapter B, Chapter 133, Local Government Code.
251	251	(e) The comptroller shall deposit the fees received under
252	252	Section 133.151(a)(5), 133.1151(a)(3), or 133.1152(3), Local
253	253	Government Code, [this section] to the credit of the judicial and
254	254	court personnel training fund established under Section 56.001.
255	255	(f) The comptroller may audit the records of a county
256	256	related to costs and fees collected under Section 133.151(a)(5),
257	257	133.1151(a)(3), or 133.1152(3), Local Government Code [this
258	258	section].
259	259	(g) Money spent from costs and fees collected under Section
260	260	133.151(a)(5), 133.1151(a)(3), or 133.1152(3), Local Government

1292	1292	(6) a fee imposed by a county officer under Section
1293	1293	118.011 or 118.052, Local Government Code.
1294	1294	SECTION 34. Section 133.004, Local Government Code, as
1295	1295	amended by Chapters 718 (H.B. 2359), 1027 (H.B. 1623), and 1149
1296	1296	(S.B. 1119), Acts of the 80th Legislature, Regular Session, 2007,
1297	1297	is reenacted and amended to read as follows:
1298	1298	Sec. 133.004. CIVIL FEES. This chapter applies to the
1299	1299	following civil fees:
1300	1300	(1) the consolidated fee on filing in district court
1301	1301	imposed under Section 133.151;
1302	1302	(2) the filing fee in district court for basic civil
1303	1303	legal services for indigents imposed under Section 133.151(a)(2)
1304	1304	[133.152];
1305	1305	(3) the filing fee in courts other than district court
1306	1306	for basic civil legal services for indigents imposed under Section
1307	1307	133.1511(a)(1) or 133.1512(1) [133.153];
1308	1308	(4) the filing fees for the judicial fund imposed in
1309	1309	certain statutory county courts under Section 133.1511(c) of this
1310	1310	code or Section 51.702, Government Code;
1311	1311	(5) the filing fees for the judicial fund imposed in
1312	1312	certain county courts under Section 133.1511(d) of this code or
1313	1313	Section 51.703, Government Code;
1314	1314	(6) the filing fees for the judicial fund imposed in
1315	1315	[certain] statutory probate courts under Section 133.1511(e)
1316	1316	[51.704, Government Code];
1317	1317	(7) fees collected under Section 118.015;
1318	1318	(8) marriage license fees for the family trust fund
1319	1319	collected under Section 118.018;
1320	1320	(9) marriage license or declaration of informal
1321	1321	marriage fees for the child abuse and neglect prevention trust fund
1322	1322	account collected under Section 118.022;
1323	1323	(10) the filing fee for the judicial fund imposed in
1324	1324	district court, statutory county court, and county court under
1325	1325	Section 133.151(a)(3) or 133.1511(b) [Section 133.154]; [and]
1326	1326	(11) the portion of the civil or administrative
1327	1327	penalty described by Section 542.406(c)(1), Transportation Code,
1328	1328	imposed by a local authority to enforce compliance with the
1329	1329	instructions of a traffic-control signal; and
1330	1330	(12) [(11)] the portion of the civil or administrative
1331	1331	penalty described by Section 707.008(a)(1), Transportation Code,
1332	1332	imposed by a local authority to enforce compliance with the
1333	1333	instructions of a traffic-control signal.
1334	1334	SECTION 35. Section 133.058(d), Local Government Code, is
1335	1335	amended to read as follows:
1336	1336	(d) A county may not retain a service fee on the collection
1337	1337	of a fee:
1338	1338	(1) for the judicial fund;
1339	1339	(2) under Article 42A.303 or 42A.653, Code of Criminal
1340	1340	Procedure;
1341	1341	(3) under Section 133.1511(a)(2) or 133.1512(2) of
1342	1342	this code or Section 51.851, Government Code; or
1343	1343	(4) under Section 133.1511(a)(3) or 133.1512(3)
1344	1344	[51.971, Government Code].
1345	1345	SECTION 36. Section 133.151, Local Government Code, is
1346	1346	amended to read as follows:
1347	1347	Sec. 133.151. CONSOLIDATED CIVIL FEE ON FILING A CIVIL SUIT
1348	1348	IN DISTRICT COURT. (a) In addition to each fee collected under
1349	1349	Section 51.317(b)(1), Government Code, the clerk of a district
1350	1350	court shall collect the following fees on the filing of any civil
1351	1351	action or proceeding requiring a filing fee and on the filing of any
1352	1352	counterclaim, cross-action, intervention, interpleader, or
1353	1353	third-party action requiring a filing fee [suit]:
1354	1354	(1) [$45 for family law cases and proceedings as
1355	1355	defined by Section 25.0002, Government Code; and
1356	1356	[(2)] $50 to be used as provided by Subsection (c) [for
1357	1357	any case other than a case described by Subdivision (1)];
1358	1358	(2) $10 to be used as provided by Section 133.152;
1359	1359	(3) $42 to be used as provided by Section 133.154;
1360	1360	(4) $30 to be used as provided by Section 51.851,
1361	1361	Government Code;
1362	1362	(5) $5 to be used as provided by Section 51.971,
1363	1363	Government Code; and
1364	1364	(6) $5 court costs fee to be deposited in the appellate
1365	1365	justice system fund appropriate for the appellate district in which
1366	1366	the court is located to be used as provided by Subchapter C, Chapter
1367	1367	22, Government Code.
1368	1368	(b) The fees under Subsection (a)(1) [(a)] shall be
1369	1369	collected and remitted to the comptroller in the manner provided by
1370	1370	Subchapter B.
1371	1371	(c) The comptroller shall allocate the fees received under
1372	1372	Subsection (a)(1) [this section] to the following accounts and
1373	1373	funds so that each receives to the extent practicable, utilizing
1374	1374	historical data as applicable, the same amount of money the account
1375	1375	or fund would have received if the fees for the accounts and funds
1376	1376	had been collected and reported separately:
1377	1377	(1) the judicial fund to be used for court-related
1378	1378	purposes for the support of the judiciary; and
1379	1379	(2) the basic civil legal services account of the
1380	1380	judicial fund for use in programs approved by the supreme court that
1381	1381	provide basic civil legal services to an indigent.
1382	1382	SECTION 37. Subchapter D, Chapter 133, Local Government
1383	1383	Code, is amended by adding Sections 133.1511 and 133.1512 to read as
1384	1384	follows:
1385	1385	Sec. 133.1511. CONSOLIDATED CIVIL FEE ON FILING CIVIL SUIT
1386	1386	IN STATUTORY COUNTY COURT, STATUTORY PROBATE COURT, OR COUNTY
1387	1387	COURT. (a) The clerk of a statutory county court, statutory
1388	1388	probate court, or a county court shall collect the following fees on
1389	1389	the filing of any civil action or proceeding and on the filing of
1390	1390	any counterclaim, cross-action, intervention, interpleader, or
1391	1391	third-party action requiring a filing fee:
1392	1392	(1) $10 to be used as provided by Section 133.153;
1393	1393	(2) $30 to be used as provided by Section 51.851,
1394	1394	Government Code;
1395	1395	(3) $5 to be used as provided by Section 51.971,
1396	1396	Government Code; and
1397	1397	(4) $5 court costs fee to be deposited in the appellate
1398	1398	justice system fund appropriate for the appellate district in which
1399	1399	the court is located to be used as provided by Subchapter C, Chapter
1400	1400	22.
1401	1401	(b) The clerk of a statutory county court or a county court
1402	1402	shall collect a fee of $42 on the filing of any suit to be used as
1403	1403	provided by Section 133.154.
1404	1404	(c) The clerk of a statutory county court shall collect a
1405	1405	$40 filing fee in each civil case filed in the court to be used for
1406	1406	court-related purposes for the support of the judiciary as provided
1407	1407	by Section 51.702, Government Code.
1408	1408	(d) In addition to all other fees authorized or required by
1409	1409	other law, the clerk of a county court with a judge who is entitled
1410	1410	to an annual salary supplement from the state under Section 26.006,
1411	1411	Government Code, shall collect a $40 filing fee in each civil case
1412	1412	filed in the court to be used for court-related purposes for the
1413	1413	support of the judiciary as provided by Section 51.703, Government
1414	1414	Code.
1415	1415	(e) In addition to all other fees authorized or required by
1416	1416	other law, the clerk of a statutory probate court shall collect a
1417	1417	$40 filing fee in each probate, guardianship, mental health, or
1418	1418	civil case filed in the court to be used for court-related purposes
1419	1419	for the support of the judiciary.
1420	1420	Sec. 133.1512. CONSOLIDATED CIVIL FEE ON FILING CIVIL SUIT
1421	1421	IN JUSTICE COURT. The clerk of a justice court shall collect the
1422	1422	following fees on the filing of any civil action or proceeding
1423	1423	requiring a filing fee and on the filing of any counterclaim,
1424	1424	cross-action, intervention, interpleader, or third-party action
1425	1425	requiring a filing fee:
1426	1426	(1) $6 to be used as provided by Section 133.153;
1427	1427	(2) $10 to be used as provided by Section 51.851(c),
1428	1428	Government Code; and
1429	1429	(3) $5 to be used as provided by Section 51.971,
1430	1430	Government Code.
1431	1431	SECTION 38. Sections 133.152(b) and (c), Local Government
1432	1432	Code, are amended to read as follows:
1433	1433	(b) The fees under Section 133.151(a)(2) [this section]
1434	1434	shall be collected and remitted to the comptroller in the manner
1435	1435	provided by Subchapter B.
1436	1436	(c) The comptroller shall deposit the fees received under
1437	1437	Section 133.151(a)(2) to the credit of the basic civil legal
1438	1438	services account of the judicial fund for use in programs approved
1439	1439	by the supreme court that provide basic civil legal services to an
1440	1440	indigent.
1441	1441	SECTION 39. Sections 133.153(b) and (c), Local Government
1442	1442	Code, are amended to read as follows:
1443	1443	(b) The fees under Section 133.151(a)(3) shall be collected
1444	1444	and remitted to the comptroller in the manner provided by
1445	1445	Subchapter B.
1446	1446	(c) The comptroller shall deposit the fees received under
1447	1447	Section 133.151(a)(3) to the credit of the basic civil legal
1448	1448	services account of the judicial fund for use in programs approved
1449	1449	by the supreme court that provide basic civil legal services to an
1450	1450	indigent.
1451	1451	SECTION 40. Section 133.154(b), Local Government Code, is
1452	1452	amended to read as follows:
1453	1453	(b) The treasurer shall remit the fees collected under
1454	1454	Section 133.151(a)(3) or 133.1511(b) [this section] to the
1455	1455	comptroller in the manner provided by Subchapter B. The comptroller
1456	1456	shall deposit the fees in the judicial fund.
1457	1457	SECTION 41. The following sections are repealed:
1458	1458	(1) Section 108.006, Family Code;
1459	1459	(2) Section 51.702(a), Government Code;
1460	1460	(3) Section 51.703(a), Government Code;
1461	1461	(4) Section 51.704(a), Government Code;
1462	1462	(5) Section 51.851(b), Government Code;
1463	1463	(6) Sections 101.06111, 101.08111, 101.0813,
1464	1464	101.10111, 101.12121, and 101.1411, Government Code;
1465	1465	(7) Sections 102.042, 102.062, and 102.103,
1466	1466	Government Code;
1467	1467	(8) Section 152.0522, Human Resources Code;
1468	1468	(9) Section 152.1752(d), Human Resources Code;
1469	1469	(10) Sections 152.1874 and 152.2496, Human Resources
