55 AN ACT
66 relating to the consolidation and allocation of state civil court
77 costs; increasing certain civil court costs.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 22.2021(b), Government Code, is amended
1010 to read as follows:
1111 (b) To fund the system, the commissioners court shall use
1212 the court costs fee collected as provided by Sections 133.151(a)(6)
1313 and 133.1511(a)(4), Local Government Code, [ set a court costs fee
1414 of not more than $5] for each civil suit filed in county court,
1515 county court at law, probate court, or district court in the county.
1616 SECTION 2. Section 22.2031(b), Government Code, is amended
1717 to read as follows:
1818 (b) To fund the system, the commissioners court shall use
1919 the court costs fee collected as provided by Sections 133.151(a)(6)
2020 and 133.1511(a)(4), Local Government Code, [set a court costs fee
2121 of $5] for each civil suit filed in county court, statutory county
2222 court, statutory probate court, or district court in the county.
2323 SECTION 3. Section 22.2041(b), Government Code, is amended
2424 to read as follows:
2525 (b) To fund the system, the commissioners court shall use
2626 the court costs fee collected as provided by Sections 133.151(a)(6)
2727 and 133.1511(a)(4), Local Government Code, [set a court costs fee
2828 of $5] for each civil suit filed in county court, county court at

3737 SECTION 5. Section 22.2061(b), Government Code, is amended

4444 SECTION 6. Section 22.2071(b), Government Code, is amended

5151 SECTION 7. Section 22.2081(b), Government Code, is amended

5858 SECTION 8. Section 22.2091(b), Government Code, is amended
5959 to read as follows:
6060 (b) To fund the system, the commissioners court shall use
6161 the court costs fee collected as provided by Sections 133.151(a)(6)
6262 and 133.1511(a)(4), Local Government Code, [set a court costs fee
6363 of $5] for each civil suit filed in a county court, statutory county
6464 court, statutory probate court, or district court in the county.
6565 SECTION 9. Section 22.2101(b), Government Code, is amended
6666 to read as follows:
6767 (b) To fund the system, the commissioners court shall use
6868 the court costs fee collected as provided by Sections 133.151(a)(6)
6969 and 133.1511(a)(4), Local Government Code, [set a court fee of $5]
7070 for each civil suit filed in county court, county court at law,
7171 probate court, or district court in the county.
7272 SECTION 10. Subchapter C, Chapter 22, Government Code, is
7373 amended by adding Section 22.2111 to read as follows:
7474 Sec. 22.2111. APPELLATE JUDICIAL SYSTEM. (a) The
7575 commissioners court of each county in the Tenth Court of Appeals
7676 District by order entered in its minutes shall establish an
7777 appellate judicial system to:
7878 (1) assist the court of appeals for the county in the
7979 processing of appeals filed with the court of appeals from the
8080 county courts, statutory county courts, statutory probate courts,
8181 and district courts; and
8282 (2) defray costs and expenses incurred in the
8383 operation of the court of appeals.
8484 (b) To fund the system, the commissioners court shall use
8585 the court costs fee collected as provided by Sections 133.151(a)(6)
8686 and 133.1511(a)(4), Local Government Code, for each civil suit
8787 filed in county court, statutory county court, statutory probate
8888 court, or district court in the county.
8989 (c) The court costs fee does not apply to a suit filed by any
9090 governmental entity or to a suit for delinquent taxes.
9191 (d) The court costs fee shall be taxed, collected, and paid
9292 as other court costs in a suit. The clerk of the court shall collect
9393 the court costs fee set under this section and pay it to the county
9494 officer who performs the county treasurer's functions. That officer
9595 shall deposit the fee in a separate appellate judicial system fund
9696 for the court of appeals district. The fund may not be used for any
9797 other purpose.
9898 (e) The funds collected under this section must be forwarded
9999 monthly to the court of appeals for expenditure by the court of
100100 appeals.
101101 (f) The chief justice of the court of appeals is responsible
102102 for management of the funds forwarded to the court of appeals under
103103 this section and has sole discretion as to the use of the funds,
104104 except that the funds must be used for purposes consistent with the
105105 purposes of the appellate judicial system as described by
106106 Subsection (a).
107107 SECTION 11. Section 22.2121(b), Government Code, is amended
108108 to read as follows:
109109 (b) To fund the system, the commissioners court shall use
110110 the court costs fee collected as provided by Sections 133.151(a)(6)
111111 and 133.1511(a)(4), Local Government Code, [set a court costs fee
112112 of $5] for each civil suit filed in county court, statutory county
113113 court, probate court, or district court in the county.
114114 SECTION 12. Section 22.2131(b), Government Code, is amended
115115 to read as follows:
116116 (b) To fund the system, the commissioners court shall use
117117 the court costs fee collected as provided by Sections 133.151(a)(6)
118118 and 133.1511(a)(4), Local Government Code, [set a court costs fee
119119 of $5] for each civil suit filed in county court, statutory county
120120 court, probate court, or district court in the county.
121121 SECTION 13. Section 22.2141(b), Government Code, is amended
122122 to read as follows:
123123 (b) To fund the system, the commissioners court shall use
124124 the court costs fee collected as provided by Sections 133.151(a)(6)
125125 and 133.1511(a)(4), Local Government Code, [set a court costs fee
126126 of not more than $5] for each civil suit filed in a county court,
127127 county court at law, probate court, or district court in the county.
128128 SECTION 14. Section 26.007(a), Government Code, is amended
129129 to read as follows:
130130 (a) Beginning on the first day of the state fiscal year, the
131131 state shall annually compensate each county that collects the
132132 additional fees and costs under Section 51.703 of this code or
133133 Section 133.1511(d), Local Government Code, in an amount equal to
134134 $5,000 if the county judge is entitled to an annual salary
135135 supplement from the state under Section 26.006.
136136 SECTION 15. Sections 51.702(c) and (d), Government Code,
137137 are amended to read as follows:
138138 (c) Court costs and fees due under this section or Section
139139 133.1511(c), Local Government Code, shall be collected in the same
140140 manner as other fees, fines, or costs are collected in the case.
141141 (d) The clerk shall deposit the fees and costs collected
142142 under this section or Section 133.1511(c), Local Government Code,
143143 to be sent to the comptroller as provided by Subchapter B, Chapter
144144 133, Local Government Code. The comptroller shall deposit the fees
145145 in the judicial fund.
146146 SECTION 16. Sections 51.703(c), (d), and (f), Government
147147 Code, are amended to read as follows:
148148 (c) Court costs and fees due under this section or Section
149149 133.1511(d), Local Government Code, shall be collected in the same
150150 manner as other fees, fines, or costs are collected in the case.
151151 (d) The clerk shall deposit the fees and costs collected
152152 under this section or Section 133.1511(d), Local Government Code,
153153 to be sent to the comptroller as provided by Subchapter B, Chapter
154154 133, Local Government Code. The comptroller shall deposit the fees
155155 in the judicial fund.
156156 (f) A clerk may not collect a fee under Section 133.1511(d),
157157 Local Government Code, [this section] and under Section
158158 133.1511(c), Local Government Code [51.702(a)].
159159 SECTION 17. Sections 51.704(b), (c), and (i), Government
160160 Code, are amended to read as follows:
161161 (b) Court fees due under Section 133.1511(e), Local
162162 Government Code, [this section] shall be collected in the same
163163 manner as other fees, fines, or costs are collected in the case.
164164 (c) The clerk shall deposit the fees collected under Section
165165 133.1511(e), Local Government Code, [this section] to be sent to
166166 the comptroller as provided by Subchapter B, Chapter 133, Local
167167 Government Code. The comptroller shall deposit the fees in the
168168 judicial fund.
169169 (i) A clerk may not collect a fee under Section 133.1511(e),
170170 Local Government Code, [this section] and under Section [51.701 or]
171171 51.702 of this code or Section 133.1511(c), Local Government Code.
172172 SECTION 18. Sections 51.851(b), (c), (e), (f), (g), (i),
173173 (j), and (k), Government Code, are amended to read as follows:
174174 (b) In addition to other fees authorized or required by law,
175175 the clerk of the supreme court or[,] a court of appeals[, a district
176176 court, a county court, a statutory county court, or a statutory
177177 probate court] shall collect a $30 fee on the filing of any civil
178178 [action or proceeding requiring a filing fee, including an]
179179 appeal[, and on the filing of any counterclaim, cross-action,
180180 intervention, interpleader, or third-party action requiring a
181181 filing fee] to be used as provided by Section 51.852. A fee
182182 authorized by Section 133.151(a)(4) or 133.1511(a)(2), Local
183183 Government Code, by a district court, a county court, a statutory
184184 county court, or a statutory probate court on the filing of any
185185 civil action or proceeding requiring a filing fee and on the filing
186186 of any counterclaim, cross-action, intervention, interpleader, or
187187 third-party action requiring a filing fee shall be used as provided
188188 by Section 51.852.
189189 (c) A fee authorized by Section 133.1512(2), Local
190190 Government Code, [In addition to other fees authorized or required
191191 by law, the clerk of a justice court shall collect a $10 fee] on the
192192 filing of any civil action or proceeding requiring a filing fee,
193193 including an appeal, and on the filing of any counterclaim,
194194 cross-action, intervention, interpleader, or third-party action
195195 requiring a filing fee shall [to] be used as provided by Section
196196 51.852.
197197 (e) A court may waive payment of a court cost or fee due
198198 under this section or Section 133.151(a)(4), 133.1511(a)(2), or
199199 133.1512(2), Local Government Code, for an individual the court
200200 determines is indigent.
201201 (f) Court costs and fees due under this section or Section
202202 133.151(a)(4), 133.1511(a)(2), or 133.1512(2), Local Government
203203 Code, shall be collected in the same manner as other fees, fines, or
204204 costs in the case.
205205 (g) The clerk of a district court, a county court, a
206206 statutory county court, a statutory probate court, or a justice
207207 court shall deposit the court costs and fees collected under this
208208 section or Section 133.151(a)(4), 133.1511(a)(2), or 133.1512(2),
209209 Local Government Code, in the appropriate local treasury and remit
210210 the court costs and fees to the comptroller in the manner provided
211211 by Subchapter B, Chapter 133, Local Government Code.
212212 (i) The comptroller shall deposit the court costs and fees
213213 received under this section or Section 133.151(a)(4),
214214 133.1511(a)(2), or 133.1512(2), Local Government Code, to the
215215 credit of the statewide electronic filing system fund established
216216 under Section 51.852.
217217 (j) The comptroller may audit the records of a county
218218 related to costs and fees collected under this section or Section
219219 133.151(a)(4), 133.1511(a)(2), or 133.1512(2), Local Government
220220 Code.
221221 (k) Money spent from costs and fees collected under this
222222 section or Section 133.151(a)(4), 133.1511(a)(2), or 133.1512(2),
223223 Local Government Code, is subject to audit by the state auditor.
224224 SECTION 19. Section 51.971, Government Code, is amended to
225225 read as follows:
226226 Sec. 51.971. JUDICIAL AND COURT PERSONNEL TRAINING FEE.
227227 (a) A filing fee required by Section 133.151(a)(5),
228228 133.1151(a)(3), or 133.1152(3), Local Government Code, is [In
229229 addition to other fees authorized or required by law, the clerk of a
230230 district court, county court, statutory county court, statutory
231231 probate court, or justice court shall collect a $5 fee on the filing
232232 of any civil action or proceeding requiring a filing fee, including
233233 an appeal, and on the filing of any counterclaim, cross-action,
234234 intervention, interpleader, or third party action requiring a
235235 filing fee] to be used as provided under Section 56.003.
236236 (b) A court may waive payment of a fee due under Section

244244 (d) The clerk of a district court, county court, statutory
245245 county court, statutory probate court, or justice court shall
246246 deposit the court costs and fees collected under Section
247247 133.151(a)(5), 133.1151(a)(3), or 133.1152(3), Local Government
248248 Code, [this section] in the appropriate local treasury and remit
249249 the court costs and fees to the comptroller in the manner provided
250250 under Subchapter B, Chapter 133, Local Government Code.
251251 (e) The comptroller shall deposit the fees received under
252252 Section 133.151(a)(5), 133.1151(a)(3), or 133.1152(3), Local
253253 Government Code, [this section] to the credit of the judicial and
254254 court personnel training fund established under Section 56.001.
255255 (f) The comptroller may audit the records of a county
256256 related to costs and fees collected under Section 133.151(a)(5),
257257 133.1151(a)(3), or 133.1152(3), Local Government Code [this
258258 section].
259259 (g) Money spent from costs and fees collected under Section
260260 133.151(a)(5), 133.1151(a)(3), or 133.1152(3), Local Government
261261 Code, [this section] is subject to audit by the state auditor.
262262 SECTION 20. Section 101.0611, Government Code, as effective
263263 September 1, 2019, is amended to read as follows:

13511351 action or proceeding requiring a filing fee and on the filing of any
13521352 counterclaim, cross-action, intervention, interpleader, or
13531353 third-party action requiring a filing fee [suit]:
13541354 (1) [$45 for family law cases and proceedings as
13551355 defined by Section 25.0002, Government Code; and
13561356 [(2)] $50 to be used as provided by Subsection (c) [for
13571357 any case other than a case described by Subdivision (1)];
13581358 (2) $10 to be used as provided by Section 133.152;
13591359 (3) $42 to be used as provided by Section 133.154;
13601360 (4) $30 to be used as provided by Section 51.851,
13611361 Government Code;
13621362 (5) $5 to be used as provided by Section 51.971,
13631363 Government Code; and
13641364 (6) $5 court costs fee to be deposited in the appellate
13651365 justice system fund appropriate for the appellate district in which
13661366 the court is located to be used as provided by Subchapter C, Chapter
13671367 22, Government Code.
13681368 (b) The fees under Subsection (a)(1) [(a)] shall be
13691369 collected and remitted to the comptroller in the manner provided by
13701370 Subchapter B.
13711371 (c) The comptroller shall allocate the fees received under
13721372 Subsection (a)(1) [this section] to the following accounts and
13731373 funds so that each receives to the extent practicable, utilizing
13741374 historical data as applicable, the same amount of money the account
13751375 or fund would have received if the fees for the accounts and funds
13761376 had been collected and reported separately:
13771377 (1) the judicial fund to be used for court-related
13781378 purposes for the support of the judiciary; and
13791379 (2) the basic civil legal services account of the
13801380 judicial fund for use in programs approved by the supreme court that
13811381 provide basic civil legal services to an indigent.
13821382 SECTION 37. Subchapter D, Chapter 133, Local Government
13831383 Code, is amended by adding Sections 133.1511 and 133.1512 to read as
13841384 follows:
13851385 Sec. 133.1511. CONSOLIDATED CIVIL FEE ON FILING CIVIL SUIT
13861386 IN STATUTORY COUNTY COURT, STATUTORY PROBATE COURT, OR COUNTY
13871387 COURT. (a) The clerk of a statutory county court, statutory
13881388 probate court, or a county court shall collect the following fees on
13891389 the filing of any civil action or proceeding and on the filing of
13901390 any counterclaim, cross-action, intervention, interpleader, or
13911391 third-party action requiring a filing fee:
13921392 (1) $10 to be used as provided by Section 133.153;
13931393 (2) $30 to be used as provided by Section 51.851,
13941394 Government Code;
13951395 (3) $5 to be used as provided by Section 51.971,
13961396 Government Code; and
13971397 (4) $5 court costs fee to be deposited in the appellate
13981398 justice system fund appropriate for the appellate district in which
13991399 the court is located to be used as provided by Subchapter C, Chapter
14001400 22.
14011401 (b) The clerk of a statutory county court or a county court
14021402 shall collect a fee of $42 on the filing of any suit to be used as
14031403 provided by Section 133.154.
14041404 (c) The clerk of a statutory county court shall collect a
14051405 $40 filing fee in each civil case filed in the court to be used for
14061406 court-related purposes for the support of the judiciary as provided
14071407 by Section 51.702, Government Code.
14081408 (d) In addition to all other fees authorized or required by
14091409 other law, the clerk of a county court with a judge who is entitled
14101410 to an annual salary supplement from the state under Section 26.006,
14111411 Government Code, shall collect a $40 filing fee in each civil case
14121412 filed in the court to be used for court-related purposes for the
14131413 support of the judiciary as provided by Section 51.703, Government
14141414 Code.
14151415 (e) In addition to all other fees authorized or required by
14161416 other law, the clerk of a statutory probate court shall collect a
14171417 $40 filing fee in each probate, guardianship, mental health, or
14181418 civil case filed in the court to be used for court-related purposes
14191419 for the support of the judiciary.
14201420 Sec. 133.1512. CONSOLIDATED CIVIL FEE ON FILING CIVIL SUIT
14211421 IN JUSTICE COURT. The clerk of a justice court shall collect the
14221422 following fees on the filing of any civil action or proceeding
14231423 requiring a filing fee and on the filing of any counterclaim,
14241424 cross-action, intervention, interpleader, or third-party action
14251425 requiring a filing fee:
14261426 (1) $6 to be used as provided by Section 133.153;
14271427 (2) $10 to be used as provided by Section 51.851(c),
14281428 Government Code; and
14291429 (3) $5 to be used as provided by Section 51.971,
14301430 Government Code.
14311431 SECTION 38. Sections 133.152(b) and (c), Local Government
14321432 Code, are amended to read as follows:
14331433 (b) The fees under Section 133.151(a)(2) [this section]
14341434 shall be collected and remitted to the comptroller in the manner
14351435 provided by Subchapter B.
14361436 (c) The comptroller shall deposit the fees received under
14371437 Section 133.151(a)(2) to the credit of the basic civil legal
14381438 services account of the judicial fund for use in programs approved
14391439 by the supreme court that provide basic civil legal services to an
14401440 indigent.
14411441 SECTION 39. Sections 133.153(b) and (c), Local Government
14421442 Code, are amended to read as follows:
14431443 (b) The fees under Section 133.151(a)(3) shall be collected
14441444 and remitted to the comptroller in the manner provided by
14451445 Subchapter B.
14461446 (c) The comptroller shall deposit the fees received under
14471447 Section 133.151(a)(3) to the credit of the basic civil legal
14481448 services account of the judicial fund for use in programs approved
14491449 by the supreme court that provide basic civil legal services to an
14501450 indigent.
14511451 SECTION 40. Section 133.154(b), Local Government Code, is
14521452 amended to read as follows:
14531453 (b) The treasurer shall remit the fees collected under
14541454 Section 133.151(a)(3) or 133.1511(b) [this section] to the
14551455 comptroller in the manner provided by Subchapter B. The comptroller
14561456 shall deposit the fees in the judicial fund.
14571457 SECTION 41. The following sections are repealed:
14581458 (1) Section 108.006, Family Code;
14591459 (2) Section 51.702(a), Government Code;
14601460 (3) Section 51.703(a), Government Code;
14611461 (4) Section 51.704(a), Government Code;
14621462 (5) Section 51.851(b), Government Code;
14631463 (6) Sections 101.06111, 101.08111, 101.0813,
14641464 101.10111, 101.12121, and 101.1411, Government Code;
14651465 (7) Sections 102.042, 102.062, and 102.103,
14661466 Government Code;
14671467 (8) Section 152.0522, Human Resources Code;
14681468 (9) Section 152.1752(d), Human Resources Code;
14691469 (10) Sections 152.1874 and 152.2496, Human Resources
14701470 Code;
14711471 (11) Section 133.152(a), Local Government Code;

14741474 SECTION 42. This Act takes effect September 1, 2021.
