5	5	A BILL TO BE ENTITLED
6	6	AN ACT
7	7	relating to the projects that may be undertaken by a public
8	8	improvement district.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 372.003, Local Government Code, is
11	11	amended by amending Subsection (b) and adding Subsection (b-2) to
12	12	read as follows:
13	13	(b) A public improvement project may include:
14	14	(1) landscaping;
15	15	(2) erection of fountains, distinctive lighting, and
16	16	signs;
17	17	(3) acquiring, constructing, improving, widening,
18	18	narrowing, closing, or rerouting of sidewalks or of streets, any
19	19	other roadways, or their rights-of-way;
20	20	(4) construction or improvement of pedestrian malls;
21	21	(5) acquisition and installation of pieces of art;
22	22	(6) acquisition, construction, or improvement of
23	23	libraries;
24	24	(7) acquisition, construction, or improvement of
25	25	off-street parking facilities;
26	26	(8) acquisition, construction, improvement, or
27	27	rerouting of mass transportation facilities;
28	28	(9) acquisition, construction, or improvement of
29	29	water, geothermal water conveyance, wastewater, or drainage
30	30	facilities or improvements;
31	31	(10) the establishment or improvement of parks;
32	32	(11) projects similar to those listed in Subdivisions
33	33	(1)-(10);
34	34	(12) acquisition, by purchase or otherwise, of real
35	35	property, including a right-of-way or easement, in connection with
36	36	an authorized improvement;
37	37	(13) special supplemental services for improvement
38	38	and promotion of the district, including services relating to
39	39	advertising, promotion, health and sanitation, water and
40	40	wastewater, public safety, security, business recruitment,
41	41	development, recreation, and cultural enhancement;
42	42	(14) payment of expenses incurred in the
43	43	establishment, administration, and operation of the district; and
44	44	(15) the development, rehabilitation, or expansion of
45	45	affordable housing.
46	46	(b-2) Payment of expenses under Subsection (b)(9) may also
47	47	include expenses related to the operation and maintenance of a
48	48	geothermal water conveyance facility or improvement.
49	49	SECTION 2. Section 372.023(a), Local Government Code, is
50	50	amended to read as follows:
51	51	(a) Costs of improvements may be paid or reimbursed by any
52	52	combination of the methods described by this section if the
53	53	improvements are dedicated, conveyed, leased, or otherwise
54	54	provided to or for the benefit of:
55	55	(1) a municipality or county;
56	56	(2) a political subdivision or other entity exercising
57	57	the powers granted under this subchapter as authorized by other
58	58	law; [or]
59	59	(3) an entity that:
60	60	(A) is approved by the governing body of an
61	61	entity described by Subdivision (1) or (2); and
62	62	(B) is authorized by order, ordinance,
63	63	resolution, or other official action to act for an entity described
64	64	by Subdivision (1) or (2); or
65	65	(4) an entity subject to the regulatory jurisdiction
66	66	of the Public Utility Commission of Texas.
67	67	SECTION 3. This Act takes effect September 1, 2021.
